1.The development hereby approved shall be carried out in accordance with the following plans and details approved within the following Outline Planning Permission and Approval of Reserved Matters unless stated otherwise: Outline Planning application reference 06/18/0315/O, in regard to the site and means of access: - Drawing no 151058-C-001-P7 - Site plan P/A1413/05/02A Approval of Reserved Matters reference 06/21/0970/D, in regard to details of the layout, scale, appearance, and landscaping of the development and other details reserved by conditions as shown on the following drawing numbers and documents: - Drawing No. 1665/1 Rev H - Site Layout Plan including soft landscaping and schedule of works to all dwellings - Drawing No. 1665/8 4 Bed Bungalow Type B3 (plots 1 and 2) - Drawing No. 1665/2 4 Bed House Type A1 (plot 3) - Drawing No. 1665/3 4 Bed House Type A2 (plot 4) - Drawing No. 1665/6 Rev C - 2 Bed House Types A3 and A4 (plots 5 - 8) - Drawing No. 1665/4 3 Bed Bungalow Type B (plots 9 and 11) - Drawing No. 1665/7 2 Bed Bungalow Type B1 (plots 10 and 12) - Drawing No. 1665/5 - Garages - Archaeology Report Number CB722R v.1.1 - Construction Traffic Management Plan 10 August 2022 Rev A - Traffic Management Plan 1665/10 Rev A (Oct. '22) - Flood Risk Assessment and Drainage Strategy ref: 125/2022/FRADS Rev P2 dated December 2022 The reason for the condition is :- In accordance with the submitted details and for the avoidance of doubt.
2.The roads, footways, street lighting, foul and surface water drainage shall be carried out in accordance with Drawing No.1665-1 Rev H Site Layout Plan, Flood Risk Assessment and Drainage Strategy ref: 125/2022/FRADS Rev P2 dated December 2022, (and Drawing No. 125/2022/013 Rev P3 dated 06/12/23 - Foul Water Drainage Network, as submitted and approved under application ref. 06/24/0004/CD). All construction works shall be carried out in accordance with the approved plans. The reason for the condition is :- To ensure fundamental elements of the development are designed effectively, and to ensure highway safety.
3.Prior to the occupation of the final dwelling all works shall be carried out on roads/footways/street lighting/foul and surface water sewers in accordance with the approved specification to the satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure satisfactory development of the site and to ensure estate roads are constructed to a standard suitable for adoption as public highway.
4.Before any dwelling is first occupied the road(s) and footway(s) shall be constructed to binder course surfacing level from the dwelling to the adjoining County road in accordance with the details to be approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure satisfactory development of the site.
5.Prior to the first occupation of the development hereby permitted visibility splays shall be provided in full accordance with the details indicated on the approved plan, drawing 151058-C-001-P7. The splay(s) shall thereafter be maintained at all times free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety in accordance with the principles of the NPPF
6.The scheme detailing provision for on-site parking for construction workers as detailed on Traffic Management Plan 1665/10 Rev A (Oct. '22), approved under the reserved matters application reference 06/21/0970/D, shall be adhered to for the duration of the construction period. The reason for the condition is :- To ensure adequate off-street parking during construction in the interests of highway safety.
7.The Construction Traffic Management Plan and Access Route, as indicated on Traffic Management Plan 1665/10 Rev A (Oct. 2022) and Construction Traffic Management Plan (August 2022) Rev A, approved under the reserved matters application reference 06/21/0970/D, shall be adhered to for the duration of the construction period. The reason for the condition is :- In the interests of maintaining highway efficiency and safety.
8.For the duration of the construction period all traffic associated with (the construction of) the development will comply with the Construction Traffic Management Plan and use only the 'Construction Traffic Access Route' and no other local roads unless approved in writing with the Local Planning Authority. The reason for the condition is :- In the interests of maintaining highway efficiency and safety.
9.Notwithstanding the details indicated on the submitted drawings no works above slab level shall commence on site unless otherwise agreed in writing with the Local Planning Authority until detailed drawings for the off-site highway improvement works as indicated on Drawing 151058-C-001-P7 have been submitted to the Local Planning Authority for approval. There shall be no occupation of five dwellings or more on the site, prior to these works being approved. The reason for the condition is :- To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor.
10.Prior to occupation of five dwellings on the site, the approved off-site highway improvement works (including Public Rights of Way works) referred to in condition 9 shall be completed to the written satisfaction of the Local Planning Authority. The reason for the condition is :- To ensure that the highway network is adequate to cater for the development proposed and that the works are delivered at an appropriate time.
11.No works shall commence on the site until the Traffic Regulation Order for extensions of the 30mph speed limit on Martham Road has been promoted by the Local Highway Authority. The reason for the condition is :- In the interests of highway safety.
12.The development shall accord with the archaeological written scheme of investigation reference WSI CB722 v.1.0 (April 2022), as approved under application reference 06/22/0592/CD. No development shall take place other than in accordance with the written scheme of investigation. The reason for the condition is :- In order to enable investigation and recording of this site of archaeological interest to take place during the period of building or engineering works in accordance with paragraph 187 of the National Planning Policy Framework.
13.The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the archaeological written scheme of investigation approved under condition 12 and the provision to be made for analysis, publication and dissemination of results and archive deposition has been secured. The reason for the condition is:- In order to enable investigation and recording of this site of archaeological interest to take place during the period of building or engineering works in accordance with the provisions of the National Planning Policy Framework.
14.A boundary wall to a height of no less than 1.8m shall be constructed at the boundary of the development with the donor property known as Hall View, in accordance with the details on drawing reference 1665/1 Rev H, approved under the reserved matters application reference 06/21/0970/D. The wall shall be erected in accordance with the details approved prior to the first occupation of the development and shall be retained in perpetuity. The reason for the condition is :- To protect the amenities of future occupiers of the adjacent dwelling from traffic noise and disturbance.
15.Prior to the installation of any external lighting details shall be submitted to and approved by the Local Planning Authority. Lighting shall be installed in accordance with the agreed details. The reason for the condition is:- To ensure that the light produced by the development is not excessive and does not adversely impact the surrounding area or wildlife.
16.Bird and bat boxes shall be provided, as detailed on the following plans, as approved under application reference 06/24/0005/CD: - Site layout plan 1665/1 Rev H indicating bird and bat boxes by dwelling/plot number - Swift and Sparrow nest box details - Kent Bat box details - Description of location of bat and bird boxes by dwelling/plot number These shall be installed prior to the occupation of the dwelling to which they relate or if they are not related to a dwelling prior to the occupation of the 4th dwelling on site. The reason for the condition is :- To ensure that there are ecological enhancements included as part of the scheme.
17.The boundary treatment shall be installed in accordance with drawing reference 1665/1 Rev H, approved under the reserved matters application reference 06/21/0970/D. The boundary treatment shall include gaps measuring 10cm x 10cm at ground level at each boundary. The reason for the condition is:- To allow the free passage of small animals and to mitigate against the adverse impacts of the loss of habitat.
18.The surface water management strategy shall be carried out in accordance with the Flood Risk Assessment and Drainage Strategy ref: 125/2022/FRADS Rev P2 dated December 2022, as approved under the reserved matters application reference 06/21/0970/D. No hard-standing areas to be constructed until the works have been carried out in accordance with the strategy. The reason for the condition is:- These details have not been submitted as part of the application and are required to ensure a satisfactory form of development.
19.The fire hydrant, as detailed on drawing Site Layout Plan 1665-1 Rev H, approved under the reserved matters application reference 06/21/0970/D shall be installed in accordance with the approved details prior to occupation of the development. The reason for the condition is:- The condition is a pre commencement condition to ensure that the development is designed in a way to accommodate the fire hydrant and it is to be installed in the interest of public safety.
20.The existing hedge located at the eastern boundary of the application site shall be retained. The reason for the condition is :- In the interests of the visual amenities of the locality.
21.Construction work shall not take place outside the following hours:- 07:30 to 18:00 Monday to Friday 08:00 to 13:00 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
22.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
23.The development shall be carried out in accordance with 151058-C-001-P7, the residential development shall be contained within the site plan P/A1413/05/02A. This permission is for a maximum of 13 dwellings only. The reason for the condition is :- For the avoidance of doubt.
24.NOTES - Please read the following notes carefully:- This permission is subject to a s106 agreement dated the 14th May 2021. The development has the potential to create dust, an adequate supply of water should be available at all times for supressing dust, there shall be no burning on site and mechanical cutting equipment should have internal dust suppression.
