1.Condition 4 requires that a contamination Site Investigation Report is submitted to and approved in writing by the Local Planning Authority and that any mitigation or remediation measures are then carried out accordance with the approved details prior to first use of the development. The application is supported by the following documentation: - Cover Letter - 'Preliminary Risk Assessment Report' Project No. 21-53 dated July 2021 by 4D Geo Ltd. - 'Geotechnical Assessment Report' dated 31 January 2024 by 4D Geo Ltd. The submitted information is considered insufficient to discharge condition 4. The Geotechnical Assessment Report is more of a summary than a comprehensive risk assessment and has not been conducted in accordance with the Governments guidance 'Land Contamination Risk Management'. The conceptual model produced in the Preliminary Risk Assessment Report has not been revisited in the later report. Moreover, there are concerns that: soil test samples have not been fully interpreted; chemicals were found below SGVs for a commercial end use but it has not been discussed whether this has any implications for ground water contamination; and, there is a lack of clarity over what the below ground tank contained. Also, a proper risk assessment should be carried out with regard to the ground gas issue the Geotechnical Assessment Report has identified along with remediation/mitigation measures to allow for the end use. Given the above, the submitted information is not sufficient to discharge condition 4 and the application is REFUSED.
