1.This permission hereby granted shall expire at the end of THREE years from the date of this decision. The reason for the condition is:- In order to retain control over the use of the site where a trial run is considered necessary in order to assess the effect of the development on the amenities of the locality and highway safety in accordance with policies CS16 of the Core Strategy and A1 of Local Plan Part 2.
2.The development shall be carried out in accordance with the revised plan received by the Local Planning Authority on the 1st August 2024: - Drawing no. 1902/1 Rev. B. The reason for the condition is :- For the avoidance of doubt.
3.Prior to first use of the development hereby permitted, the 2no. car parking spaces as indicated on drawing ref. 1902/1 Rev. B, shall be laid out and retained thereafter for that specific use. The reason for the condition is :- For the avoidance of doubt and in the interests of highway safety in accordance with policy CS16 of the Core Strategy.
4.External seating to the front of the Tap Room shall be restricted to 2no. wooden benches in the location as indicated on drawing ref. 1902/1 Rev. B. The reason for the condition is :- In the interest of the amenities of the locality, in accordance with policies CS9 of the Core Strategy and A1 of Local Plan Part 2.
5.The use hereby permitted shall be restricted to use as a Tap Room (Sui Generis) with ancillary retail sale directly associated with the tap room only. The reason for the condition is :- For the avoidance of doubt and for the Local Planning Authority to retain control over the operation of the site in the interest of the amenities of the locality and highway safety in accordance with policies CS16 of the Core Strategy and A1 of Local Plan Part 2.
6.The use hereby permitted shall be operated in strict accordance with the noise mitigation measures document, received on the 15th July 2024. The reason for the condition is:- In the interest of the amenities of the locality, as in accordance with policies CS9 of the Core Strategy and A1 of Local Plan Part 2.
7.There shall be no use of the development hereby permitted outside of the following hours:- - 12:00 hrs to 20:00 hrs Sunday to Wednesday - 12:00 hrs to 21:00 hrs Thursday to Saturday - 12:00 hrs to 20:00 hrs Bank Holidays or Public Holidays The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings in accordance with local plan policy A1.
8.The development hereby permitted shall only be connected to the mains sewer network. The development shall thereafter remain connected for the duration of its use. The reason for the condition is: - To ensure there is no detrimental impact on internationally-protected wildlife sites in accordance with policies CS11 and GSP5, and to secure the mitigation required to allow the development to pass the Appropriate Assessment required by the Conservation of Species and Habitats Regulations 2017 (as amended).
9.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
