1.The proposed development (construction of a new hipped roof over the existing garage and conversion of garage) must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority on 18 April 2024: - Location Plan, Scale 1:1250 (Received 18.04.2024) - 551-02a Proposed Plan & Elevations, Scale 1:100/1:1250 (Received 10.07.2024) - 551-03a Existing and Proposed Sections, Scale 1:100 (Received 23.07.2024) The reason for the condition is:- For the avoidance of doubt.
3.For the avoidance of doubt, further to the details shown on the submitted amended plans, the existing decking shall be lowered to a height of no more than 20cm when measured from the surface of the existing adjacent paving, or 30cm from the original ground level, as shown on approved Drawing No. 551-03a Existing and Proposed Sections. The works to lower the decking shall be carried out and completed no later than 2 (two) calendar months from the date of this decision (i.e. by 27 September 2024). The reason for the condition is:- In the interests of protecting the residential amenity of neighbouring dwellings by reducing the level of impact to an extent otherwise accepted under permitted development whereby decking shall not exceed 300mm in height when measured from existing / original ground levels. Dwg No. 551-03a shows that the top of the proposed decking will measure 0.3m from the original ground level and 0.2m from the existing paving slabs surface. This condition ensures that the current unauthorised decking will be lowered to an acceptable height within a suitable timeframe to ensure that the opportunity to overlook into West View's rear garden and French doors has been removed by the time the 'Mature Acer Maple Trees' shed their leaves.
4.The chamfering of the eaves and roof corners of the existing rear extension shall be undertaken and carried out in full, in accordance with Drawing No. 551-02a 'Proposed Plans and Elevations' no later than 4 calendar months from the date of this decision (i.e. by 27 November 2024). The reason for the condition is:- In the interests of protecting the amenity of neighbouring dwellings by reducing the overbearing impact that the unauthorised existing extension has on the adjoining properties and to ensure appropriate visual amenity by removing the uncomfortable design relationship and detrimental impact in the wider area which the development creates in its current form.
5.INFORMATIVE NOTE: - The applicant is advised that the Borough Council will review the site after 2 and 4 calendar months from the date of this decision (26 July 2024); where these unauthorised works remain in place and the works required by Conditions 3 and 4 of this permission have not been constructed in accordance with the approved plans to the required timescales, the Local Planning Authority will consider whether formal planning enforcement measures should be instigated to remedy the breach of conditions and/or enforce the unauthorised works which were refused under previous application 06/23/0642/HH on 18 March 2024.
