1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 9th April 2024: - Site Location Plan; 06137.00-KLH-XX-ZZ-DR-A-0001 Rev P04 - Proposed Site Block Plan; 06137.00-KLH-XX-ZZ-DR-A-0302 Rev P04 - Proposed Site Landscape Plan; 06137.00-KLH-XX-ZZ-DR-A-0303 Rev P04 - Proposed Ground and First Floor Plan; 06137.00-KLH-XX-ZZ-DR-A-1003 Rev P05 - Flood Risk Assessment Rev P02 (3 Parts) (prepared by Clancy Consulting) - Drainage Strategy Rev P01 (3 Parts) (prepared by Clancy Consulting). - Contaminated Land Assessment (6 Parts), Reference: GN26275_DS (prepared by Harrisons) - Emergency External Lighting (prepared by JSH). - Noise Impact Assessment, Reference: 14003/1 (prepared by Adrian James Acoustics Limited). - Transport Statement (2 Parts), Reference: 241080 (prepared by Rossi Long Consulting). - Biodiversity Net Gain Design Statement (prepared by Wild Frontier Ecology). - Surface Water Management Plan (prepared by Morgan Sindall Construction) - Construction Management Plan (CMP) Rev A (prepared by Morgan Sindall Construction) and the following revised document received on the 17th June: - Ecological Assessment dated June 2024 (prepared by Wild Frontier Ecology). and the following revised plan received on the 20th June 2024: - Proposed Elevations; 06137.00-KLH-XX-ZZ-DR-A-2001 Rev P07 The reason for the condition is:- For the avoidance of doubt.
3.Prior to the first use of the development hereby permitted, full details of the cycle parking, as indicated on dwg. ref. 06137.00-KLH-XX-ZZ-DR-A-0303 Rev P03, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development hereby approved is first brought into use and thereafter retained for this purpose. The reason for the condition is:- To ensure the permanent availability of adequate cycle parking that meets the needs of occupiers of the proposed development and in the interests of encouraging the use of sustainable modes of transport.
4.Prior to first use a Travel Information Plan shall be submitted to and approved in writing by the Local Planning Authority. The Travel Information Plan shall include information to ensure sustainable travel options are identified as relevant to the development, it shall be updated as necessary and implemented as long as any part of the development is occupied. The reason for the condition is:- To ensure that the development offers a wide range of travel choices to reduce the impact of travel and transport on the environment.
5.If, during development, contamination not previously identified is found to be present, then no further development shall be carried out in pursuance of this permission until a scheme has been submitted to and approved by the Council as Local Planning Authority detailing how this contamination shall be dealt with in accordance with the remediation scheme as set out above. Only when evidence is provided to confirm the contamination no longer presents an unacceptable risk, can development continue. The reason for the condition is:- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with section 179 of the NPPF.
6.Prior to the installation of any plant and/or machinery, including any replacements of such, full details including location, acoustic specifications, and specific measures to control noise from the equipment shall be submitted to and approved in writing by the Local Planning Authority. The plant/machinery installed must meet the proposed plant noise rating level limits at the nearest residences as detailed in Table 6 of the AJA Acoustics Report 14003/1. The equipment shall be installed, used and maintained thereafter in full accordance with the approved details. The reason for the condition is:- In order to prevent undue nuisance to nearby occupiers.
7.PART (A) - The development hereby permitted shall be carried out in accordance with the submitted Biodiversity Net Gain measures within the Landscaping Plan ref. 06137.00-0303 P03, Biodiversity Net Gain Preliminary Design Stage Report (March 2024) and Ecological Assessment (June 2024), sufficient to ensure that there is a minimum 10% net gain in biodiversity provided within the development for a minimum 30 year period from the first use of the development, and the measures hereby approved shall be implemented in full. PART (B) - Prior to occupation, There shall be no use or beneficial occupation of the development hereby permitted until a full specification of precise planting has first been submitted which has regard to in respect of the Landscaping Plan drawing ref. 06137.00-0303 P03. The subsequently approved planting and seeding shall thereafter be carried out in no later than the first planting and seeding season following the first use or beneficial occupation of the building. The landscaping scheme and Biodiversity Net Gain measures shall thereafter be retained and maintained for a minimum of 30 years from planting, unless express permission for their alterations or removal has first been granted by the Local Planning Authority. Any trees or plants which within a period of 30 years from occupation planting die, are removed or become seriously damaged or diseased, shall be replaced no later than in the next planting season with others of similar size and species. The reason for the condition is:- In the interests of ensuring measurable net gains to biodiversity and to secure public improvements to visual amenity, in accordance with Policies CS9, CS11 of the Core strategy and Policy E4 of Local Plan Part 2.
8.There shall be no use or beneficial occupation of the development hereby permitted until a Biodiversity Method Statement to ensure that there is a minimum 10% net gain in biodiversity within a 30 year period as a result of for the development has first been submitted to and agreed in writing by the Local Planning Authority. The Biodiversity Method Statement shall reflect the agreed Biodiversity Net Gain Measures within the Biodiversity Net Gain Preliminary Design Stage Report (March 2024) hereby approved, and shall include: - Purpose and objectives for the proposed works, - Detailed designs and/or working methods necessary to achieve the stated objectives - Timetable for implementation, demonstrating that works are aligned to the proposed phasing of construction, - Persons responsible for implementation of the works, - Initial aftercare and long-term maintenance (where relevant); - Disposal of any wastes arising from works; and; - a monitoring regime, comprising either (i) proposals and commitments to ensure that regular monitoring is undertaken and reported to the Local Planning Authority, or (ii) a scheme for ensuring appropriate provisions for monitoring can be undertaken by or on behalf of the Local Planning Authority, which shall first be agreed in partnership with the Local Planning Authority. The works shall be carried out strictly in accordance with the approved details and shall be retained in that manner thereafter. The reason for the condition is:- In the interests of ensuring measurable net gains to biodiversity and to secure public improvements to visual amenity, in accordance with Policies CS9, CS11 of the Core strategy and Policy E4 of Local Plan Part 2.
9.The external lighting proposed on site, as per the Emergency External Lighting document (prepared by JSH), shall strictly accord with the recommendations of section 6 of the Ecological Assessment dated June 2024 (prepared by Wild Frontier Ecology) hereby approved. This measures are as follows: - Using hoods or cowls over light fittings to reduce lateral and upward light pollution and focus the light precisely onto the areas it is needed. - Positioning light fittings to face directly downwards and at angles of no greater than 90°to the ground can reduce overspill of light and sky glow, which otherwise disrupt the nocturnal behaviours of bats and insects. - Use of Light-Emitting Diodes (LED) rather than other bulb types. LEDs lack ultra-violet (UV) light elements, which have been shown to be the parts of the spectrum most disruptive to bats. In addition, a warm, white light source should be used, at 2,700 Kelvin or lower. Light sources should feature peak wavelengths higher than 550nm to avoid the component of light which is most disturbing to bats. - Where possible, motion-sensor activated lights should be used, to illuminated areas only when people are present, and for one to two minutes at a time. This ensure lighting is not on and causing light pollution throughout the night. The lighting shall be installed in accordance with the approved details and shall be retained in that manner thereafter. The reason for the condition is:- In the interests of visual amenity and for ensuring lighting does not impact bats, in accordance with Policies CS9, CS11 of the Core strategy and Policy E4 of Local Plan Part 2.
10.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
11.NOTES - Please read the following notes carefully:- NOTE: The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future.
12.NOTES - Please read the following notes carefully:- Essex and Suffolk Water state: Our records show that we have 63, 90 & 125 mm PE mains the vicinity of Northgate Hospital. Please see the attached map showing the position of our assets. A minimum clearance depth of 300mm from our main should be maintained. Any pipes to be installed can cross our main at a right angle (90 degrees). An easement width of 3m should be maintained on either side of the pipe between the pipe and your works. Should there be any change in location or depth please let us know. We ask that the party carrying out these works undertake one trial hole to confirm the location and depth of these assets before proceeding with any works, these should be hand dug. Please find the guidance to working near Essex and Suffolk Water assets. Any damages to our asset during these works by your party and chosen contractor will incur charges which will be charged in full directly to you to repair and will be liable for all damages that may arise.
