| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following revised plans and supporting documents:
- Proposed site location and and block plan; drawing reference: 1711/1 Rev A
- Plot 1 floor plans and elevations; drawing reference: 1711/5 Rev B
- Plot 2 floor plans and elevations; drawing reference: 1711/6 Rev B
- Garage Plan; drawing reference: 1711/4 (received 4th September 2024)
- Arboricultural Impact Assessment; document reference: OAS 21-374-AR01 dated February 2024 - and in particular Tree Protection Plan Drawing No. OAS 21-347-TS03
The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning. |
| 3. | PRE-COMMENCEMENT CONDITION
No development shall commence (excluding site clearance and demolition) until such time that a Biodiversity Gain Plan has first been submitted to and approved in writing by the Local Planning Authority. The Plan must demonstrate how the development will achieve at least 10% biodiversity net gain, including the use of registered off-site biodiversity units.
The Biodiversity Gain Plan must include:
- The statutory biodiversity metric calculation showing pre and post development values and the resulting net gain.
- Details of the off-site land proposed to deliver biodiversity units, including its registration on the Biodiversity Gain Site Register.
- A completed allocation of off-site units to this development, confirmed by the landowner or habitat bank operator.
- A copy of the completed legal agreement securing the delivery, management and monitoring of the off-site habitat for a minimum of 30 years, in accordance with the Environment Act 2021.
- A timetable for habitat delivery and monitoring consistent with the approved development programme.
The development shall thereafter be carried out in accordance with the approved Biodiversity Gain Plan, and the off-site habitat enhancements shall be maintained for no less than 30 years from the date they are first implemented.
The reason for the condition is:- To provide certainty that off-site biodiversity units are secured, deliverable and appropriately managed, preventing a failure to meet statutory BNG obligations after permission is granted. |
| 4. | PRE-COMMENCEMENT CONDITION
No development shall take place until such time that an Arboricultural Method Statement has first been submitted to and approved in writing by the Local Planning Authority. The Arboricultural Method Statement shall:
- detail the location where building materials will be stored;
- outline a strategy for movement of construction machinery that does not impact the Root Protection Area of trees within TPO No.4 2022;
- detail tree protection measures (including tree protection fencing which will be in place for the duration of the construction period); and,
- include details of the no-dig construction method for the driveways and areas of hard-standing as shown on Drawing No. OAS 21-347-TS03
The development shall be carried out in strict accordance with the approved Arboricultural Method Statement throughout the course of construction.
The reason for the condition is:- To ensure that the protected trees are not adversely impact during the construction of the approved dwellings; in accordance with Core Strategy (2015) Policy CS11 and Local Plan Part 2 (2021) Policy E4.
This condition needs to be a pre-commencement condition as it relates to matters related to the construction of the proposed dwellings. |
| 5. | PRIOR TO ANY CONSTRUCTION WORKS STARTING ON THE DWELLINGS
No works to the dwellings hereby approved (including the digging of foundations) shall take place until such time that the existing vehicular access indicated on the approved drawing (1711/1 Rev A) has first been upgraded/widened to a minimum width of 8 metres in accordance with the Norfolk County Council residential access construction specification for the first 5 metres as measured from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway.
Reason:- To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety and traffic movement; in accordance with Core Strategy (2015) Policy CS16. |
| 6. | PRIOR TO ANY CONSTRUCTION WORKS STARTING ON THE DWELLINGS
No works to the dwellings hereby approved (including the digging of foundations) shall take place until such time that a visibility splay measuring 2.4 metres x 23 metres (Cycle Infrastructure Design Local Transport Note 1/20 (DoT July2020) has first been provided to the western side of the vehicular access to the site where it meets the near edge of the adjacent highway footway/cycleway. The splay shall thereafter be maintained at all times free from any obstruction exceeding 0.6metres above the level of the adjacent highway carriageway.
Reason:- In the interests of highway safety; in accordance with Core Strategy (2015) Policy CS16. |
| 7. | PRIOR TO ANY WORKS ABOVE SLAB LEVEL
No works shall take place above slab level until such time that the exact types and colours of the materials to be used in the walls and roof of the proposed dwellings and garages has first been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out using the agreed materials and retained thereafter.
For the avoidance of doubt, this shall include a sample panel of the new brick work showing the details of the proposed brick bond and mortar type/colour.
The reason for the condition is:- To ensure that the proposed materials are suitable for the surrounding character and that the details of the brickwork are in keeping with the donor dwelling; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A2. |
| 8. | PRIOR TO ANY WORKS ABOVE SLAB LEVEL
No works shall take place above slab level such time that details in written and drawn form of the means by which electric vehicle charging shall be made available has first been submitted to and approved by the local planning authority. The works shall accord to the approved scheme and shall be retained thereafter.
The reason for the condition is:- To allow provision for the demand for electric vehicle charging within the lifetime of the development; in line with the requirements of the adopted Great Yarmouth Local Plan Part 2 (2021) Policy I1. |
| 9. | PRIOR TO ANY WORKS ABOVE SLAB LEVEL
No works above slab level shall take place until such time that full details of a soft landscaping scheme have first been submitted to and approved in writing by the Local Planning Authority. The precise details of the landscaping proposals shall include a planting plan detailing full specifications of all new planting along with details for their protection during establishment.
For the avoidance of doubt, all species used in the planting proposal shall be locally native species of local provenance.
The development shall be carried out in full accordance with the approved landscaping scheme prior to the first occupation of the dwellings hereby approved. For the duration of a period of 10 years from the first occupation of the chalets hereby permitted, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species.
The reason for the condition is:- Because the precise details have not been submitted and in the interests of the satisfactory visual amenity and biodiversity enhancement; in accordance with Core Strategy Policies CS09 and CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 10. | PRIOR TO ANY WORKS ABOVE SLAB LEVEL
No works above slab level shall take place until such time that details of proposed positions, design, materials, planting and type of all boundary treatment to be erected / planted / retained have first been submitted to and approved in writing by the Local Planning Authority.
Notwithstanding the proposals or notes shown on site layout plan 1711/1 Rev A, no fencing shall be installed or erected or placed along the boundaries of the site without first gaining the express written permission of the Local Planning Authority.
The reason for the condition is:- In the interests of visual amenities of the locality, to enhance the character of the area and in the interests of satisfactory appearance of the development, in accordance with Core Strategy Policies CS09 and CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 11. | PRIOR TO ANY WORKS ABOVE SLAB LEVEL
No works above slab level shall take place until such time that a biodiversity enhancement plan has first been submitted to and approved in writing by the Local Planning Authority, detailing the enhancement measures for biodiversity on site. The measures shall be carried out strictly in accordance with the approved scheme and retained in the approved form for the lifetime of the development.
The reason for the condition is:- To provide biodiversity enhancements on site; in accordance with Core Strategy (2015) Policy CS11. |
| 12. | Any access gates/bollard/chain/other means of obstruction shall be hung to open inwards, set back, and thereafter retained a minimum distance of 8 metres from the near channel edge of the adjacent carriageway.
The reason for the condition is:- In the interests of highway safety enabling vehicles to safely draw off the highway before the gates/obstruction is opened; in accordance with Core Strategy (2015) Policy CS16. |
| 13. | Prior to the first occupation of the development hereby permitted the proposed access/on-site car parking and turning areas as indicated on Drawing No. 1711/1 Rev A shall be laid out, demarcated, levelled and surfaced in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is:- To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety; in accordance with Core Strategy (2015) Policy CS16. |
| 14. | The dwellings shall be constructed to meet the requirements of optional Building Regulations Standard M4(2) (Accessible and Adaptable Dwellings). The dwellings shall thereafter be retained in accordance with this standard for the lifetime of the development.
The reason for the condition is:- To ensure that the dwellings are adaptable to meet current and future needs; in accordance with Local Plan Part 2 (2021) Policy A2. |
| 15. | The dwellings shall be constructed to provide sound attenuation against external noise and ensure internal sound levels no greater than:
a) 35dB LAeq (16 hour) in the main living rooms of the dwelling(s) (for daytime and evening use); and
b) 30dB LAeq (8 hour)/45dB LAmax (fast) in the bedrooms of the dwelling(s) (for night-time use) in line with World Health Organisation guidance, with windows shut and other means of ventilation provided.
The reason for the condition is:- To ensure adequate living conditions for future occupiers and to World Health Organisation guidance levels; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1. |
| 16. | If, during development, contamination not previously identified is found to be present, then no further development shall be carried out in pursuance of this permission until a scheme has been submitted to and approved by the Council as Local Planning Authority detailing
how this contamination shall be dealt with in accordance with the remediation scheme as set out above. Only when evidence is provided to confirm the contamination no longer presents an unacceptable risk, can development continue.
The reason for the condition is:- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with Local Plan Part 2 (2021) Policy E6.

| 17. | Construction work shall not take place outside the following hours:-
- 08:00 to 18:00 Mondays
- 08:00 to 18:00 Tuesdays
- 08:00 to 18:00 Wednesdays
- 08:00 to 18:00 Thursdays
- 08:00 to 18:00 Fridays
- 08:30 to 13:30 Saturdays
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is:- In the interests of the residential amenities of the occupiers of nearby dwellings; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1. |
| 18. | No external lighting shall be erected unless full details of its design, location, orientation and level of illuminance have first been submitted to and agreed in writing with the local planning authority. Such lighting shall be kept to the minimum necessary for the purposes of security and site safety and shall prevent upward and outward light radiation. The lighting shall thereafter be implemented accordance with the approved details and shall be retained as such thereafter.
The reason for the condition is:- To mitigate the impact of uncontrolled external lighting on protected species and dark skies, in accordance with Core Strategy (2015) Policy CS11 and Local Plan Part 2 (2021) Policy E6. |
| 19. | The first floor window on the east elevation to plot 2 (serving room labelled as en-suite on drawing reference 1711/6 Rev B) shall be fitted with obscure glass to a level equivalent to Pilkington Privacy Level 5 which shall be installed prior to the first occupation of the dwelling and this obscure glazing shall be retained thereafter in perpetuity.
The reason for the condition is:- In the interests of the residential amenities of the occupiers of nearby properties; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1. |
| 20. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £608.34 received 24-05-25 and for off-site public open space provision and enhancement amounting to £2621.34 (received 07-11-25). |

Great Yarmouth Borough Council has a duty to ensure that roads and streets within the Borough are properly named and that the properties fronting onto them are appropriately numbered. Therefore it is essential that once planning permission has been granted, and prior to the completion of development, the developer/owner applies for an official address. This Authority has adopted the legislation set out in sections 17, 18 and 19 of The Public Health Act 1925. Air Quality - Construction:
The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed:
· An adequate supply of water shall be available for suppressing dust.
· Mechanical cutting equipment with integral dust suppression should be used.
· There shall be no burning of any materials on site, or burial of asbestos, which should instead be removed by an EA licenced waste carrier, and the waste transfer notes retained as evidence.
Construction noise notification:
The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems.
Contamination Disclaimer:
The responsibility for the safe development and secure occupancy of the site rests with the developer. The local planning authority has determined the application on the basis of the information available to it, but this does not mean that the land is free from contamination, or that the land could not be declared Contaminated Land in future. |
| 23. | NOTES - Please read the following notes carefully:-
As informed by the submitted Preliminary Ecology Appraisal:
- The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. While trees and scrub are likely to contain nesting birds between 1st March and 31st August inclusive buildings can also support nesting birds. If works occur during the nesting period a careful check of the building by a competent ecologist should be undertaken to assess the nesting bird activity on the site during this period and has shown it is absolutely certain that nesting birds are not present.
- Removal of debris must be undertaken by hand and piles slowly dismantled to ensure if any Hedgehogs, Common Amphibians or Small Mammals are present, they can be carefully removed (or allowed to disperse) to minimise likelihood of injury.
- Should these species be found a receptor area may be required for translocation.
- It is recommended that a suitable refugia is created prior to construction which can serve as a receptor for any wildlife found or as a wildlife enhancement should not wildlife be present in debris piles during their removal. |
