| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans and documents received by the Local Planning Authority on the 18th June 2024:
- Site Location Plan
- "GigaBox centrifugal fans" product sheet
- "Odour Management Plan, Ventilation and Impact Statement"
And the development shall be carried out in accordance with the following revised plans and documents received by the Local Planning Authority on the 1st October 2024:
- Noise Impact Assessment dated 19/09/2024
And the development shall be carried out in accordance with the following revised plans and documents received by the Local Planning Authority on the 14th November 2024:
- Proposed rear elevations / Section; Drawing Number: P103 Rev.R2
- Proposed Floor and Roof Plans; Drawing Number: P102 Rev.R2
The reason for the condition is:-
For the avoidance of doubt and in the interests of proper planning and maintaining the amenity of neighbouring residents. |
| 3. | No use of the premises as a hot food takeaway shall take place until such time that a detailed commercial waste management scheme has been first submitted to and approved in writing by the Local Planning Authority. Provision shall be made for bin storage to be contained within the rear yard only and not stored outside the courtyard other than on days of collection.
The reason for the condition is:-
To mitigate any impact on neighbours and in the interests of visual amenity, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policies A1 and R7. |
| 4. | No use of the premises as a hot food takeaway shall take place until such time that a detailed public litter prevention and waste management scheme has been first submitted to and approved in writing by the Local Planning Authority.
The litter prevention and waste management scheme shall include the following information:
(a) a scheme for the provision of public litter and recycling bins;
(b) a schedule for their emptying; and
(c) details of the waste storage and collection arrangements.
These provisions as agreed shall implemented prior to the first use of the premises as a hot food takeaway and shall be retained as such thereafter for the lifetime of the development.
The reason for the condition is:-
To mitigate any impact on neighbours and to ensure and to mitigate any littering which may take place, in accordance with Local Plan Part 2 (2021) Policies A1 and R7. |
| 5. | No use of the premises as a hot food takeaway shall take place until such time that details of no fewer than 1no. bird nesting box and 1no. bat box have first been submitted to and approved in writing by the Local Planning Authority. The bird and bat boxes shall be installed in accordance with the approved details and retained as such thereafter.
The reason for the condition is:-
To ensure ecological enhancements as expected by Core Strategy (2015) Policy CS11. |
| 6. | No flue or extraction system shall be installed until such time that detail of the colour of the proposed external flue have first been submitted to and agreed in writing by the Local Planning Authority. The flue shall thereafter be installed in accordance with the approved details prior to the first use of the premises as a hot food takeaway and shall be retained and maintained thereafter in accordance for the lifetime of the development.
The reason for the condition is:-
In the interests of visual amenity and to mitigate the visual impact of the proposed flue on the external appearance of the building, in accordance with Core Strategy (2015) Policy CS9. |
| 7. | The premises shall not be open for business outside of the hours of 15:00 to 23:00 on any day.
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1. |
| 8. | The premises shall not receive deliveries outside the hours of 08:00 to 20:00 on any day. Deliveries shall only be received via the front entrance of the unit to Lowestoft Road.
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1. |
| 9. | The scheme for odour extraction and fume mitigation as approved shall be installed, used and maintained in accordance with the manufacturer's specification/instructions (detailed within the Odour Management Plan, Ventilation and Impact Statement hereby approved as part of this permission) and shall be retained and maintained as such thereafter for the duration of the use hereby permitted.
The reason for the condition is :-
To control the noise and odour emitted from the site in the interests of residential amenity, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1. |
| 10. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
