1.This permission shall expire on 30th November 2026. By this date the use shall be discontinued and the structure and its associated equipment and all associated infrastructure shall be removed from the site and the site and garden land shall be returned to its previous state and restored with replacement landscaping as necessary within two months of the cessation of the use. The reason for the condition is:- The time limited restriction is imposed in order to retain control over the use of the site, to ensure that the detrimental impact on heritage assets is temporary and repairable, and in the interest of the amenities of the locality.
2.The development shall be retained in accordance with the following plans received by the Local Planning Authority on the 7th May 2024: - Site Location Plan; Drawing Reference: AL-00-001 Rev P1 - Proposed Site Plan; Drawing Reference: AL-20-001 Rev P1 - Proposed Elevations - North and South; Drawing Reference: AE-20- 001 Rev P1 - Proposed Elevations - East and West; Drawing Reference: AE-20-002 Rev P1 - Proposed Ride Specifications; Drawing Reference: AL-20-001 Rev P1 - High Tide Waterfront Scenario and Action Plan The reason for the condition is:- For the avoidance of doubt.
3.PART A: By no later than the 30th September 2024, details of the proposed fencing and boundary treatment to enclose the slingshot ride shall be submitted to and approved in writing by the Local Planning Authority. PART B: By no later than the 1st March 2025, the existing Heras site fencing enclosing the slingshot ride shall be removed from the application site and the approved fencing and boundary treatment shall be installed in its entirety. This fencing and boundary treatment shall be retained thereafter for the lifetime of the development. Other than the approved fencing, no fencing of any type or height shall be installed or erected or used in association with the development hereby permitted at any time. The reason for the condition is:- To ensure that the existing inappropriate site fencing is removed from the site and that the replacement fencing is an appropriate high quality of design and provides visual interest to support the tourism economy and reflect the heritage of the area; in accordance with Core Strategy (2015) Policies CS8, CS9 and CS10 and Local Plan Part 2 (2021) Policies GY6 and E5.
4.There shall be no use nor installation of any amplified sound systems within the development hereby permitted, unless otherwise first agreed in writing by the Local Planning Authority. The reason for the condition is :- In the interests of maintaining residential and neighbouring amenity; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
5.There shall be no use nor installation of any flashing or strobe lighting or advertisements added within the development hereby permitted, unless otherwise first agreed in writing by the Local Planning Authority. The reason for the condition is :- In the interests of the visual amenities of the area and to ensure any lighting does not compromise navigational safety for vessels at sea and to maintain residential and neighbouring amenity; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
6.Within 30 days of the grant of this permission, all staff and operatives must have been made aware of the requirements to comply with the measures set out in the submitted High Tide Action Plan, and have first received training to implement the Flood Evacuation Plan. The High Tide Action Plan and Evacuation plan shall thereafter be maintained and retained in accordance with those submitted details for the duration of the development. The reason for the condition is :- In the interests of the safety of the public and site operatives in the event of extreme weather and/or flooding; in accordance with Core Strategy (2015) policy CS13.
7.The sling shot attraction shall not be operational outside the following times:- 10:00 - 21:00 Monday - Friday 10:00 - 22:00 Saturdays 10:00 - 21:00 Sundays, Bank and Public Holidays The reason for the condition is :- In the interests of neighbouring amenity; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
8.For the duration of the development hereby permitted, the area enclosed by the fencing shall be subject to appropriate maintenance, including regular grass cutting, to match the appearance of the mowed area of grassed public park surrounding the slingshot attraction. The reason for the condition is: - In the interests of maintaining visual amenity of the tourism attraction and conservation areas; in accordance with Core Strategy Policies (2015) CS9 and CS10.
