1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plan received by the Local Planning Authority on the 8th August 2024: - Site Location Plan; drawing reference 1648/P2/LP S13; and in accordance with the following revised plans received by the Local Planning Authority on the 1st May 2025: - Proposed Block Plan; drawing reference: 1648/P2/01 Rev.R3. - Floor Plan Lower Level 01 as Proposed; drawing reference: 1648/P2/02-1 Rev.R3. - Floor Plan Upper Level 01 as Proposed; drawing reference: 1648/P2/02-2 Rev.R3. - Floor Plan Upper Level 02 as Proposed; drawing reference: 1648/P2/02-3 Rev.R3. - Ground Floor Level Plan as Proposed; drawing reference: 1648/P2/GA/01 Rev.R3. - General Arrangement Plan Roof as Proposed; drawing reference: 1648/P2/05 Rev.R3. - Elevations 01 as proposed; drawing reference: 1648/P2/03 Rev.R3. - Elevations 02 as proposed; drawing reference: 1648/P2/04 Rev.R3. - General Arrangement Plan Upper Mezzanine Level Plan as Proposed; drawing reference: 1648/P2/GA/02 Rev.R3 The reason for the condition is:- For the avoidance of doubt to confirm what has been approved and in the interests of proper planning.
3.No development shall take place, including any works of demolition, until such time that a Demolition and Construction Management Strategy has first been submitted to and approved in writing by the Local Planning Authority. Demolition And Construction Management Strategy shall include details of the means to control impacts from construction and demolition, including materials management, noise reduction, dust suppression and contractor parking, as well as contact details of the proposed contractor to be used as first point of contact in the event of the Council receiving concern about the works underway. The reason for the condition is :- To enable the Local Planning Authority to retain control over the development in the interests of the visual and residential amenities of the locality, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
4.No development shall take place, including any works of demolition, until such time that a surface water management strategy has first been submitted to and approved in writing by the Local Planning Authority. No hard-standing areas shall be constructed until the works have been carried out in accordance with the strategy. The reason for the condition is :- To ensure adequate disposal of surface water; in accordance with Core Strategy (2015) Policy CS13.
5.No construction works above slab level shall take place until such time that details of the materials to be used in the walls and roof of the development hereby approved have first been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the details approved and shall be retained in the approved form thereafter. The reason for the condition is :- In interests of ensuring that the proposed materials are suitable for the Sea Front location and historic context, in accordance with Core Strategy (2015) Policy CS10 and Local Plan Part 2 (2021) Policy E5.
6.There shall be no construction works beyond slab level of the development hereby permitted until such time that a detailed Landscaping and Planting Strategy has first been submitted to and approved in writing by the Local Planning Authority. The approved planting scheme shall be provided in full prior to the first use of the family amusement centre hereby permitted. For the duration of a period of 10 years from the first use of the family amusement centre, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species, unless the Local Planning Authority gives its first written consent to any variation thereof. The reason for the condition is :- In the interests of providing a high-quality development and in the interests of visual amenity. To ensure that the proposed species are suitable for a marine environment; in accordance with Core Strategy (2015) Policy CS11.
7.Notwithstanding the information shown on drawing 1648/P2/04 Rev.R3, no railings or fencing shall be installed until such time that the details of the railings to the edge of the pier decking and details of the fencing to the eastern boundary of the site have first been submitted to and approved in writing by the Local Planning Authority. The fencing shall be installed in accordance with the approved details prior to the first use of the family amusement centre and shall be retained in the approved form thereafter. The reason for the condition is :- To ensure that appropriate boundary treatment is provided which compliments the design of the new family amusement centre; in accordance with Core Strategy (2015) Policies CS9 and CS10 and Local Plan Part 2 (2021) Policy E5.
8.There shall be no use of the development hereby permitted until such time that a Biodiversity Enhancement Plan has first been submitted to and approved in writing by the Local Planning Authority, detailing the enhancement measures for biodiversity on site. The approved measures shall be carried out strictly in accordance with the approved scheme prior to first use of the family amusement centre hereby permitted and retained thereafter. The reason for the condition is :- To provide biodiversity enhancements on the site; in accordance with Core Strategy (2015) Policy CS11.
9.There shall be no use of the development hereby permitted until such time that the extended pier decking (as shown on drawing 1648/P2/01 Rev.R3) has first been installed in its entirety and made operational for use. The pier decking, and access to it from the approved building, shall be made available during all operational hours of the building. The reason for the condition is :- The activity to the east of the proposed building and dual frontages provide clear public benefits which contribute to outweighing the harm of a building of this size to the special character and appearance of the Conservation Area and the setting of the nearby Grade II* Listed Winter Gardens; the scheme would not be acceptable without the activity to the east of the building; in accordance with Core Strategy (2015) Policy CS10 and Local Plan Part 2 (2021) Policy E5.
10.There shall be no use of the development hereby approved until such time that a Flood Response Plan has first been submitted to and approved in writing by the Local Planning Authority. The approved flood response plan shall be made available to all occupiers of the site and management and staff thereof at all times. The development shall be operated in accordance with the Flood Response Plan for the duration of the permission. The reason for the condition is :- To minimise the risk to the occupants in the event of flooding in accordance with Policy CS13 of the adopted Great Yarmouth Local Plan Core Strategy (2015).
11.There shall be no use of the area labelled as family amusement centre on the proposed floorplan (1648/P2/GA/01 Rev.R3) whatsoever other than as an amusement arcade with no age restriction limitations applied in respect of its users. Furthermore, at no time shall this area be used as an adult gaming centre or be restricted to use by those aged 18 and over. The reason for the condition is :- To ensure that the use remains a family friendly use and to provide the associated benefits for the tourism sector in accordance with the aims of Core Strategy (2015) Policy CS8.
12.The family amusement arcade shall not be open to customers between the hours of 23:30 and 09:00 on the following day unless otherwise first agreed in writing by the Local Planning Authority. The reason for the condition is:- For the Local Planning Authority to retain control over the use of the site in the interest of the amenity and enjoyment of the nearby hotels, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
13.No part of the proposed structure (to include fascia board/rainwater guttering) shall overhang or encroach upon highway land and no gate/door/ground floor window shall open outwards over the highway at any time. The reason for the condition is :- In the interests of highway safety, in accordance with Core Strategy (2015) Policy CS16.
14.NOTES - Please read the following notes carefully:- 1. This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. 2. Please note that it is the Applicants' responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Please contact streetworks.north@norfolk.gov.uk It is the Applicant's responsibility to clarify the boundary with the public highway. Private structures such as fences, or walls will not be permitted on highway land. The highway boundary may not match the applicant's title plan. Notification of intention to connect to the public sewer under S106 of the Water Industry Act Approval and consent wil be required by Anglian Water, under the Water Industry Act 1991. Contact Development Services Team 0345 606 6087. 4. Protection of existing assets - If a public sewer is shown on record plans within the land identified for the proposed development. It would then be recommended that the applicant contacts Anglian Water Development Services Team for further advice on this matter. Building over existing public sewers wil not be permitted (without agreement) from Anglian Water. 5. Building near to a public sewer - No building wi l be permitted within the statutory easement width of 3 metres from the pipeline without agreement from Anglian Water. Please contact Development Services Team on 0345 606 6087. 6. The developer should note that the site drainage details submitted have not been approved for the purposes of adoption. If the developer wishes to have the sewers included in a sewer adoption agreement with Anglian Water (under Sections 104 of the Water Industry Act 1991), they should contact our Development Services Team on 0345 606 6087 at the earliest opportunity. Sewers intended for adoption should be designed and constructed in accordance with Sewers for Adoption guide for developers, as supplemented by Anglian Water's requirements.
