No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 29th February 2024: - Location Plan; drawing reference: PW1355_PO5 - Location Plan, Site Plan, Ground Floor Plan, Section & Elevations of Barn A; drawing reference: PW1355_P01 - Floor Plan, Section & Elevations of Barn B; drawing reference: PW1355_P02 - Ground Floor Plan, Section & Elevations of Barn C & Barn D; drawing reference: PW1355_P03 and the development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 18th July 2024: - Proposed Site Plan; drawing reference: PW1368_P04revb The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
3.Storage use shall only take place within the barns identified on the approved site plan (PW1368_P04revb). These buildings shall only be used for storage purposes only and no business or commercial distribution activity shall be carried out, within, or from the site. The reason for the condition is :- To ensure that the development takes place in accordance with the manner proposed, to limit the intensity of the use and to mitigate any amenity or highways impacts resulting from the use; in accordance with Core Strategy (2015) Policies CS9 and CS16.
4.The storage units hereby approved shall only be made available for use between the hours of 06:30 - 20:30 in any one day. Access to the storage units outside of these hours shall not be permitted. The reason for the condition is :- In the interests of limiting noise and disruption to neighbour properties arising from the use and vehicles visiting the site; in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
5.No more than 25 individual storage containers/units within the buildings shall be made present at any one time and no more than 25 individuals shall be allowed to make use of the storage containers at any one time. The applicant shall maintain a logbook detailing individuals using the storage units and the period of time for which they are being used for. The logbook shall be completed for the duration of the use of the premises for storage, and shall be made available for officers from the Local Planning Authority to view at all times. The reason for the condition is :- To limit the intensity of the use in accordance with the information contained within the Noise Impact Assessment (Adrian James Acoustics Ltd reference 14361 M001.docx) and to limit the use of the site in the interests of highway safety; in accordance with Core Strategy (2015) Policies CS9 and CS16 and Local Plan Part 2 (2021) Policy A1.
6.No hazardous, toxic or poisonous substances shall be stored within the site at any given time. In addition none of the following items shall be stored within the site at any given time: · Combustible or flammable materials or liquids · Firearms, explosives, weapons or ammunition, · Chemicals, radioactive materials, biological agents, toxic waste and asbestos · Any item that emits any fumes, smell or odour. · Compressed gas The reason for the condition is :- In the interests of protecting the amenity of nearby residents, in accordance with Core Strategy (2015) Policy CS9 and Local Plan Part 2 (2021) Policy A1.
7.No external lighting shall be erected unless full details of its design, location, orientation and level of illuminance have first been submitted to and agreed in writing with the local planning authority. Such lighting shall be kept to the minimum necessary for the purposes of security and site safety and shall prevent upward and outward light radiation. The lighting shall thereafter be implemented accordance with the approved details and shall be retained as such thereafter. The reason for the condition is :- To mitigate the impact of uncontrolled external lighting on protected species and dark skies, in accordance with Core Strategy (2015) Policy CS11 and Local Plan Part 2 (2021) Policy E6.
8.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
