No.Condition Text
1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- Required to be imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 26th April 2024: - Proposed Site Layout Plan; Drawing No. P03 - Site Location Plan; Drawing No. P01 Rev A The reason for the condition is :- For the avoidance of doubt.
3.The hardstanding hereby approved shall accommodate no more than 4no. static caravans only, and the static caravans shall not exceed a maximum of 18no. bed spaces in total. The reason for the condition is :- For the avoidance of doubt and to ensure adequate protection of the designated habitat sites and that sufficient mitigation for recreational impacts has been accounted for, as in accordance with policy CS11 of the Core Strategy and policy GSP5 of the Local Plan Part 2, and the Conservation of Habitats and Species Regulations 2017.
4.The caravans shall only be used for holiday purposes and may only be occupied during the period from 28th February to 14th January, in any year. The units hereby approved shall not be occupied by an individual or family for more than 21 consecutive days at a time with no return within the following 21 days. The reason for the condition is:- To ensure the development is not used for year-round occupation as the site falls within a designated holiday accommodation area where the Local Planning Authority intend that new developments whether a permanent or a temporary nature will only be used for holiday accommodation.
5.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £663.51 in total (relating to the number of bed spaces being provided) towards the monitoring and mitigation provided through that Strategy.
