1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 15th May 2024: - Site Location Plan - Proposed Floor Plans and Elevations; drawing reference: 6256.01 And the development shall be carried out in accordance with the following revised plans and documentation received by the Local Planning Authority on the 18th July: - Proposed Site Plan; drawing reference: NR / SP Rev. 02 A - Cattery Business Plan The reason for the condition is:- For the avoidance of doubt.
3.There shall be no use of the outbuildings as cattery accommodation until such time that design details of the new fence to be installed along the southern boundary (as indicated on drawing NR/SP Rev 02A) have first been submitted to and approved in writing by the Local Planning Authority. The fence shall thereafter be erected in accordance with the approved details and retained as such thereafter for the lifetime of the development. The reason for the condition is: - In the interests of ensuring a positive and attractive frontage to the property and enhancing the visual amenity of the surrounding area, in accordance with Core Strategy (2015) Policy CS9, Local Plan Part 2 (2021) Policy H9 and Hemsby Neighbourhood Plan (2023) Policy 3.
4.Cat drop-offs and collections to and from the site shall be undertaken only by pre-booked appointment and there shall be no more than 3 appointments within each 30-minute time slot. The applicant shall maintain a logbook detailing appointments and visitors to the site. The logbook shall be maintained in perpetuity and shall be available for officers from the Local Planning Authority to view at all times. The reason for the condition is :- To ensure that the number of visitors is retained to a suitable level within the capacity of the available parking spaces, to mitigate the potential for vehicle conflict in the interests of highway safety, and to minimise the disturbance to surrounding properties in the interests of neighbouring amenity, in accordance with Core Strategy (2015) Policies CS09, CS16 and Local Plan Part 2 (2021) Policies A1 and I1.
5.Appointments for cat drop offs and collections shall not take place outside of the hours of 9am-4pm in each day. The reason for the condition is: - To ensure the use operates in the manner proposed, and to enable the Local Planning Authority to retain control over the site and its intensity of use, in the interests of neighbouring amenity and highway safety, in accordance with Core Strategy (2015) Policies CS09 and CS16.
6.The cattery facility hereby permitted shall only be used to board cats and shall not be used for the boarding of any other animals or for any other commercial purposes at any time. At no time shall it be sold, leased or occupied independently from the main dwelling known as New Farm Bungalow, Newport Road, Hemsby, nor shall the common ownership of the cattery and main dwelling be severed. The reason for the condition is: - To ensure the use operates in the manner proposed, and to enable the Local Planning Authority to retain control over the site and its intensity of use, in the interests of neighbouring amenity and highway safety, in accordance with Core Strategy (2015) Policies CS09 and CS16 and Local Plan Part 2 (2021) Policy A1.
7.Prior to the first occupation/use of the development hereby permitted a 2.0 metre wide parallel visibility splay (as measured back from the near edge of the adjacent highway carriageway) shall be provided across the whole of the site's roadside frontage. The splay shall thereafter be maintained at all times free from any obstruction exceeding 1.0 metres above the level of the adjacent highway carriageway. The reason for the condition is: - In the interests of highway safety in accordance with the principles of the NPPF.
8.No part of the proposed structure (the fence, including posts and their foundations) shall overhang or encroach upon highway. The reason for the condition is: - In the interests of highway safety in accordance with the principles of the NPPF and Core Strategy (2015) Policy CS16.
9.Prior to the first use of the development hereby permitted the proposed access and on-site car parking/turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety and Core Strategy (2015) Policy CS16.
10.No use of the outbuildings as Catteries shall take place until such time that landscaping details (and in particular details to improve planting and to provide a degree of screening to the car parking area) have first been submitted to and approved in writing by the Local Planning Authority. The proposed planting shall take place within the first planting season following first use of the cattery. The reason for the condition is: - To provide adequate screening to the site and to improve appearance of the site within the street scene and to provide biodiversity enhancements; in accordance with Core Strategy (2015) Policy CS11, Local Plan Part 2 (2021) E4 and Hemsby Neighbourhood Plan (2023) Policies 7 and 13.
11.Notwithstanding the approved details, no external lighting is to be installed without the prior consent of the Local Planning Authority. Details shall include the types of light appearance, position, illumination levels and light spillage. The reason for the condition is:- In the interests of mitigating light spill and in order to protected neighbour amenity, in accordance with Local Plan Part 2 (2021) Policies E6 and A1.
12.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
13.NOTES - Please read the following notes carefully:- 1. It is the Applicant's responsibility to clarify the boundary with the public highway. Private structures such as fences, or walls will not be permitted on highway land. The highway boundary may not match the applicant's title plan. For further details please contact the highway research team at highway.boundaries@norfolk.gov.uk 2. The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while the nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. While trees and scrub are likely to contain nesting birds between 1st March and 31st August inclusive buildings can also support nesting birds. If works occur during the nesting period a careful check of the building by a competent ecologist should be undertaken to assess the nesting bird activity on the site during this period and has shown it is absolutely certain that nesting birds are not present.
