1.The development hereby permitted must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in strict accordance with the following plans received by the Local Planning Authority on 5th April 2024: - Unreferenced plan, entitled Location Plan, dated 21st February 2024 - Plan no. 2409-002, entitled Proposed Details (submitted as Proposed Elevations, Floor and Section plan), dated February 2024 The reason for the condition is:- For the avoidance of doubt.
3.The outbuildings to which the refurbishments are herby approved shall be used only for purposes of private domestic storage or as an outbuilding use which is incidental to the use of the dwelling known as The Ocean Tides, The Holway, Winterton, and at no time whatsoever shall it be used as a separate dwelling or annex, and nor shall it be used for holiday purposes, whether let commercially or otherwise, nor be occupied as separate or associated units of accommodation. Neither shall any commercial storage or such activities shall take place from the outbuildings. The reason for the condition is:- For the avoidance of doubt and in the interests of the residential amenities of the occupiers of adjacent properties (in accordance with policies CS09 and A1) and in the interests of highways safety and minimising traffic impacts in accordance with Local Plan Core Strategy Policy CS16, and as no appropriate assessment has been undertaken beyond the scope of that which was proposed, and in particular with regard to recreational impacts on nearby internationally designated ecological sites as would be expected by Local Plan Part 2 Policy GSP5 where new overnight residential or tourist accommodation is proposed.
4.INFORMATIVE NOTES:- Holiday use of the outbuildings under refurbishment (including use by relatives or friends of the dwelling the subject of this application) and/or the separate letting of the outbuildings, is not considered to be a use which remains incidental to that of the dwelling and as such would require full planning permission. Further advice can be sought via the Local Planning Authority's pre-application advice service.
