1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 2nd October 2024: - Proposed Site Plan, Proposed Floor Plans and Proposed Elevations; drawing reference: 2402-001 Rev. D The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
3.The approved units of accommodation shall be used for holiday purposes only and shall not be used at any time as a person's sole or principal residence. The applicant shall maintain a logbook detailing visitors staying at the holiday lets and the period of time for which they are staying. The logbook shall be completed for the duration of the use of the premises as holiday lets, and shall be made available for officers from the Local Planning Authority to view at all times. The reason for the condition is :- To ensure the holiday unit is not used as permanent residential accommodation in accordance with policy L2 from the adopted Great Yarmouth Local Plan Part 2 (2021).
4.There shall be no use of the glamping pods hereby permitted until such time that the development has first been connected to the mains sewer system and made operational and available for use. The development shall remain connected to the public mains sewer network thereafter and no other method of dealing with foul water drainage shall be installed. The reason for the condition is :- To ensure the development will not lead to nutrient pollution concerns within the the Broads SAC catchment, by ensuring effluent is treated outside of the known Nutrient Neutrality catchment area, by connection to the mains sewerage system with subsequent effluent treatment at a water recycling centre which discharges waste outside of the Nutrient Neutrality catchment; in accordance with Local Plan Part 2 (2021) Policy I3.
5.No use of the glamping pods hereby approved shall take place until such time that detailed specifications of the type of EV charging units to be installed have been submitted to and approved in writing by the Local Planning Authority. The EV charging units shall be installed in accordance with the approved details prior to the first use of the glamping pods and retained thereafter. The reason for the condition is :- To ensure provision of EV charging on site, in accordance with Local Plan Part 2 (2021) Policy I1.
6.The approved planting/landscaping scheme (as shown on plan 2402-001 Rev. D) shall be carried out in its entirety prior to the first occupation of the glamping pods hereby approved. For the duration of a period of 10 years from the first occupation of the glamping pods hereby permitted, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species. The reason for the condition is :- To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity in accordance with Policies CS9 and CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015) and Filby Neighbourhood Plan (2022) Policies E1 and E2.
7.No occupation/use of the glamping pods shall take place until such time that the Sparrow Boxes have been installed in the locations show on the submitted plan (Homestead Sparrow Boxes). The Sparrow Boxes shall remain thereafter for the lifetime of the development. The reason for the condition is :- To ensure adequate ecological enhancement measures are provided; in accordance with Core Strategy (2015) Policy CS11 and Filby Neighbourhood Plan (2022) Policy E1.
8.Prior to the first use of the development hereby permitted the proposed on-site car parking/turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety; in accordance with Core Strategy (2015) Policy CS16.
9.No occupation/use of the glamping pods shall take place until such time that the water efficiency measures (as detailed in the submitted water efficiency statement) have been installed in their entirety. These measures shall be retained thereafter for the lifetime of the development. The reason for the condition is :- In the interests of promoting and securing water efficiency improvements to a higher standard than Building Regulations minimum standards require, to accord with adopted Local Plan Part 2 policy E7. Note to applicant - The imposition of this planning condition requires the development to achieve a higher standard of construction than the current minimum national requirement through Building Regulations. This requires you / the Developer to ensure that the standard is adhered to when seeking Building Regulations Completion Notice approval (whether using local authority inspectors or third party approved inspectors).
10.No external lighting shall be erected unless full details of its design, location, orientation and level of illuminance have first been submitted to and agreed in writing with the local planning authority. Such lighting shall be kept to the minimum necessary for the purposes of security and site safety and shall prevent upward and outward light radiation. The lighting shall thereafter be implemented accordance with the approved details and shall be retained as such thereafter. The reason for the condition is :- To mitigate the impact of uncontrolled external lighting on protected species and dark skies, in accordance with Core Strategy (2015) Policy CS11, Local Plan Part 2 (2021) Policy E6 and Filby Neighbourhood Plan (2022) Policy E4.
11.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the aims of providing small scale tourist accommodation within the countryside and complies with the requirements of Core Strategy (2015) CS8 and Local Plan Part 2 (2021) Policy L2. The proposal would not be contrary to policy BE2 which seeks to protect the Filby Village Gap and would not result in the loss of the visual and physical separation of the two parts of Filby.
