1.No development whatsoever shall take place until full details of the Appearance, Landscaping and Scale of the development (herein after referred to as the reserved matters) have been submitted to and approved by the Local Planning Authority and the development shall be carried out strictly in accordance with such approved details. The reason for the condition is :- Such details have not been submitted as part of this application.
2.The development must be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. The reason for the condition is :- Required to be imposed by Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
3.Prior to the first occupation of the development hereby permitted the vehicular access shall be provided and thereafter retained in the position shown on the approved plan drawing number: 1853/1 Rev C - (Site Plan and Garages) in accordance with the attached highway specification (Drawing No. TRAD 1). Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is :- To ensure satisfactory access into the site and avoid extraneous material or surface water from or onto the highway in the interests of highway in accordance with Core Strategy Policy CS16.
4.Notwithstanding the submitted details unless otherwise agreed in writing by the local planning authority the proposed private drive shall be maintained at a minimum width of 5.8 metres for its complete length and shall be constructed perpendicular to the highway carriageway for a minimum length of 10 metres as measured from the near edge of the highway carriageway and shall be constructed perpendicular to the highway carriageway over the said distance. The reason for the condition is :- In the interests of highway safety in accordance with Core Strategy Policy CS16.
5.Prior to the first occupation of the development hereby permitted a visibility splay measuring 2.4 X 43 metres shall be provided to each side of the access where it meets the highway and such splays shall thereafter be maintained free from any obstruction exceeding 0.225 metres above the level of the adjacent highway carriageway. The reason for the condition is :- In the interests of highway safety in accordance with Core Strategy Policy CS16.
6.Prior to the first occupation of the development hereby permitted the proposed access, on-site car parking and turning area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring area, in the interests of highway safety in accordance with Core Strategy Policy CS16 and Local Plan Part 2 Policy I1.
7.The off-site highway improvement works (footway, access and carriageway widening as appropriate) the details of which were submitted to and approved by the Local Planning Authority as part of condition discharge application 06/22/0851/CD shall be completed as approved prior to the first occupation of any of the dwellings. The reason for the condition is :- To ensure the highway improvement works are adequate to cater for the development proposed in the interests of highway safety in accordance with Core Strategy Policy CS16.
8.The development hereby permitted shall be carried out in accordance with drawing no. 1853/7 Rev B (Site Landscaping Scheme) and all boundary treatments and site landscaping as they relate to each plot shall be carried out prior to the first occupation of the dwelling on that plot and shall be retained as such thereafter. Any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. The reason for the condition is :- In the interests of the visual amenities of the area and neighbouring amenity in accordance with Local Plan Part 2 Policies A1 and E4
9.The development shall be carried out in accordance with the submitted Tree Report prepared by Farmland Forestry dated 2nd January 2024 which identifies retention and protection of hedgerows and trees. For the duration of the building works the trees and hedgerows shall be protected in accordance with the Tree Constraints Plan and Tree Protection Plan in Appendices 2 and 3 of the submitted Tree Report. The reason for the condition is :- In the interests of the visual amenities of the area in accordance with Local Plan Part 2 Policy E4.
10.The finished floor levels of the buildings hereby approved shall be in accordance with those shown on drawing no. 02/101/Rev A (Surface water drainage layout and levels layout) as part submitted Surface Water Drainage Strategy Rev A prepared by Create Consulting Engineers Limited, dated 14 February 2025. The reason for the condition is :- To ensure the development is constructed without significant changes in levels within the site in the interests of the proper development of the site having regard to drainage, retained landscape features and relationship with neighbouring properties in accordance with Core Strategy Policy CS13 and Local Plan Part 2 Policies A1 and E4.
11.The layout shall be in accordance with the approved plan Drawing No. 1853/1 Rev C - Site Plan and Garages. The reason for the condition is :- For the avoidance of doubt of what has been approved and in the interests of proper planning.
12.The means of surface water drainage for the site shall be in accordance with the submitted Surface Water Drainage Strategy Rev A prepared by Create Consulting Engineers Limited, JG/VL/P22-2537/02 Rev A, dated 14 February 2025 and in particular - - Drawing No. 02/101 Rev A, dated 13.02.25 Surface Water Drainage and Levels Layout - Drawing No. 02/102 Rev A, dated 13.02.25 Surface Water Drainage Standard Details - Drawing No. 02/103 Rev A, dated 12.02.25 Surface Water Exceedance Routes The development shall be carried out in accordance with the agreed details prior to the first occupation and shall be retained as such thereafter. It should be noted that it is the applicants/developers/owner's responsibility to ensure adequate drainage of the site so as not to adversely affect surrounding land, property or highway. The approved method of drainage also requires Land Drainage Consent from the Internal Drainage Board. The reason for the condition is :- To minimise the possibilities of flooding in accordance with Core Strategy Policy CS13.
13.Ecological mitigation/enhancement proposals for the site shall be carried out in accordance with the details including timetables for implementation as submitted to and approved by the Local Planning Authority as part of condition discharge application 06/22/0851/CD. The reason for the condition is :- In order to safeguard and enhance the ecological interests of the site in accordance with Core Strategy Policy CS11.
14.Construction work shall not take place outside the following hours:- - 07:30 to 18:00 Monday to Friday - 08:00 to 13:00 Saturday and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of neighbouring amenity in accordance with Local Plan Part 2 Policy A1.
15.The development shall be undertaken in accordance with the approved contamination and remediation details which were submitted to and approved by the Local Planning Authority as part of condition discharge application 06/22/0851/CD, prior to the first occupation of any dwelling. The reason for the condition is :- To ensure that risks from land contaminated to the future users of the land and neighbouring land are minimised, together with those controlled waters, property and ecological systems in accordance with Local Plan Part 2 Policy E6.
16.The development shall be connected to the mains sewer network for the disposal of foul drainage from this development and there shall be no other means of foul drainage disposal. The development shall thereafter remain connected. The reason for the condition is :- To avoid pollution of the water environment and direct effects on protected sites in accordance with Local Plan Part 2 Policy I3.
17.The development shall be carried out in accordance with the submitted Water Consumption details including Installation Types for House Types A, B and C prior to first occupation of each dwelling and shall be retained as such thereafter to ensure each dwelling meets the higher water efficiency standard of requirement of no more than 110 litres per person per day. The reason for the condition is :- In the interests of promoting and securing water efficiency improvements to a higher standard than Building Regulations minimum standards require, to accord with Local Plan Part 2 policy E7. Note to applicant - The imposition of this planning condition requires the development to achieve a higher standard of construction than the current minimum national requirement through Building Regulations. This requires you / the Developer to ensure that the standard is adhered to when seeking Building Regulations Completion Notice approval (whether using local authority inspectors or third party approved inspectors).
18.Prior to the first occupation of each dwelling, provision shall be made for a minimum 7Kw wired and operational electric vehicle charger - either post or wall mounted. This shall be retained as such thereafter. The reason for the condition is :- To allow provision for the demand for electric vehicle charging within the lifetime of the development in accordance with Local Plan Part 2 Policy I1.
19.The development shall be carried out in accordance with the submitted 'Statement outlining proposal compliance with Part M4(2)' requirements of Part M of the Building Regulations both externally and internally prior to the first occupation of each dwelling. The reason for the condition is :- To ensure functional, healthy and sustainable homes in accordance with Local Plan Policy A2.
20.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. It is confirmed that this shadow HRA submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017. In this instance the Borough Council has considered there is no likely significant effect on protected habitats arising solely from the development itself; and the development would contribute to the overall in-combination significant adverse effect identified by the Habitats Regulations Assessment Report for the Local Plan Core Strategy, but this effect can be adequately mitigated by the Habitats Monitoring and Mitigation Strategy; and that Strategy requires a payment of £304.17 per each additional dwelling towards the monitoring and mitigation provided through that Strategy. The payment has been made by adding to a previously paid contribution as the required contribution increased from 1st April 2025. The LPA hereby confirms the appropriate additional payment of £498.00 was received on 28 April 2025.
