1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 5th December 2023:

The reason for the condition is:-
For the avoidance of doubt. |
3. | Notwithstanding the provisions within Part 4 of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended, no more than 28 car boot sales shall be held in any calendar year, on the land outlined in red on the location plan received by the Local Planning Authority on the 5th December 2023. These events shall only take place on a Sunday between the hours of 06:00am and 15:30pm, at which time the use shall have ceased and the site shall be cleared of parking, temporary structures and associated paraphernalia.
The reason for the condition is :-
To ensure that the development is carried out in accordance with the details applied for and in the interests of highways safety and visual amenity; in accordance with Core Strategy (2015) Policies CS9 and CS16. |
4. | The dog exercising facility shall not be open for business nor made available for public use outside of the following hours:-
05:00 - 22:00 Monday to Sunday including Public and Bank Holidays.
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings; in accordance with Core Strategy (2015) Policy CS9. |
5. | Use of the site for car boot sales events shall only be undertaken in the following manner:
(i) At no time shall car boot sale vendors/sellers be positioned outside the area shown as "Proposed Car Boot Sales Area" on the northern half of the application site in the approved Site Layout Plan;
(ii) All car parking for visitors / buyers at car boot sale events shall be accommodated entirely and solely within the area shown as "Existing dog exercise field to be used as parking area on car boot days" on the southern half of the application site in the approved Site Layout Plan;
(iii) No more than 45no. vehicles shall be allowed within the area designated for trading as car boot sales vendors / sellers, at any time.
(iv) No more than 80no. vehicles shall be allowed within the area designated for car boot sales visitors/buyers sellers, at any time.
(v) At all times during the use of the site for car boot sales events, there shall be a staffed presence at the site who shall be specifically responsible for providing marshalling of all vehicles on car boot sale days, and to ensure the safe passage, entrance and egress of all vehicles to and from the site.
The reason for the condition is :-
To ensure the development operates in the manner proposed and assessed as such, in the interests of highways safety and local amenity; in accordance with Core Strategy (2015) Policies CS9 and CS16. |
6. | The access, on-site car parking//turning areas shall be laid out and demarcated shall be retained for the lifetime of the development in accordance with the approved plans and be retained for that specific use. Parking for the dog walking area shall be provided at all times sufficient for at least 3 vehicles and shall be provided with appropriate signage at all times.
The reason for the condition is: -
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Core Policy CS16. |
7. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended (or any order modifying, re-enacting or otherwise altering that order), there shall be no further external lighting (other than that included within the approved Lighting Strategy of planning permission 06/23/0477/F (LSC10944)) erected at the site whatsoever without the prior express written permission first being granted by the Local Planning Authority.
The reason for the condition is :-
To preserve the dark skies character and to limit light pollution in accordance with the expectations of Policy E6 and in the interests of highway safety in accordance with Core Policy CS16. |
8. | At least 1no. dog waste and litter bin(s) shall be retained on site and continue to be made available for users of the site for the life time of the development. The bins shall be emptied and maintained on a regular basis, and shall be retained as such thereafter.
The reason for the condition is :-
In the interests of ecological protection and public amenity. |
9. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
