| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 25th October 2023:
-Location plan, Scale 1:1250
-Proposed site plan, Scale 1:200
-Noise Impact Assessment

| 3. | Anti-vibration mountings:
No occupation of the development shall take place in pursuance of this permission until precise details of the method of installing plant and machinery equipment within, or to the premises have been submitted to and agreed in writing with the Local Planning Authority. These submitted details shall specify the use of anti-vibration mountings. The installation of the equipment shall be carried out in accordance with the details as agreed and retained as such thereafter.

In the interests of protecting local amenities and the appearance and character of the conservation area. |
| 4. | Details of Active Frontage Area:
There shall be no commencement of the use as an adult gaming centre until details of the means by which an active shopfront and display to provide changing displays or other forms of public interest within the interior of the frontage to King Street, in an area no less than 1 metre in depth when measured from the back of the window frontage, have first been submitted to and approved in writing by the Local Planning Authority.
The details shall be provided in both written description and plan/drawn form and shall include details of how the display will be maintained and amended/ updated on a regular basis in the event that a static display is proposed.
The agreed works shall be installed before the use commences and shall be retained thereafter for the duration of the use hereby permitted.
Reason:
To ensure an active shopfront is provided and retained to enhance the character and visual amenity of the area in the interests of maintaining activity, vibrancy, vitality and viability of the town centre, as set out in Local Plan Part 2 Policy R2. |
| 5. | INFORMATIVE NOTES:
Asbestos Note:
The developer is reminded that prior to any refurbishment commencing on site the building/s to be refurbished are required to be surveyed for the presence of asbestos containing materials in accordance with the Control of Asbestos Regulations 2012. Any asbestos containing materials which are identified shall be managed or removed in accordance with the above regulations and waste regulations. Failure to comply with these regulations could result in prosecution by the relevant authority.
The uncontrolled refurbishment of buildings could result in the contamination of soils on site and in the vicinity of the demolition. This could cause the investigation of the site under Part 2A of the Environmental Protection Act 1990, which may result in the determining of the site as Contaminated Land.

Trade Waste:
The applicant is advised that businesses require a Trade Waste contract to dispose of all waste associated with commercial activities as stated in the Environmental Protection Act 1990, Section 34.
Construction noise notification:
The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems.
Hours of Work:
Due to the close proximity of other residential dwellings and/or businesses, the hours of any construction or refurbishment works that are audible outside of the boundary of the site should be restricted to reduce the likelihood of noise disturbance to:
0730 hours to 1830 hours Monday to Friday
0830 hours to 1330 hours Saturdays
No work on Sundays or Bank Holidays.
Statutory Nuisance Warning:
The applicant is reminded that noise complaints received by the Environmental Protection Team would be investigated under the Environmental Protection Act 1990 (Sections 79 & 80) and can result in an abatement notice being served if a statutory noise nuisance is identified. |
