1.The proposed fence atop the existing boundary wall would represent a feature in the street scene which is harmful to visual amenity and out of keeping with the surrounding character of the area, of which this side of Kennedy Avenue is defined by bungalows with low brick walls to the front boundaries - the proposal would disrupt this and appear visually jarring. Moreover, such a boundary treatment would diminish the relationship between the dwelling and the road due to the increased levels of enclosure, reducing visual levels of activity and further harming the street scene. The proposal therefore fails to protect the relationship between buildings and streets, ensure attractive street scenes or reinforce local identity. The proposal fails therefore to comply with Core Strategy (2015) Policy CS9, Local Plan Part 2 Policy H9, The Great Yarmouth Design Code (January 2024) and and Paragraph 135 of the NPPF (December 2023).
2.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
