1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is:-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2. | The development shall be carried out in accordance with the following amended and revised plans received by the Local Planning Authority on the 3rd April 2024:
- Site/ Block Plan; ref. 3051-07A
- First Floor Plan; ref. 3051-09
And the following plan received on the 15th February 2024:
- Location Plan; ref. 3051-06b

3. | Residential use or occupation of the development hereby permitted shall be limited at all times to either a person solely or mainly employed by "Caister Vets - Caister and Rollesby", and their dependants, or no more than three persons each of whom are solely or mainly employed by the "Caister Vets - Caister and Rollesby" at the time of their occupation of the accommodation hereby permitted.
For the avoidance of doubt, the use shall at all times remain as a household as described by Class C3 of the Town and Country Planning (Use Classes Order) 1987, as amended and as may be modified in the future.
The reason for the condition is:-
The site of the development is outside an area where the local planning authority normally permit residential development and in a location which does not have a suitable environment or facilities for permanent residential occupation; however the permission has been granted in this instance having regard to the exceptional business need for a unit of short term dwelling use to be available on the site, in accordance with policies CS1, CS2 and CS6 of the Core Strategy. |
4. | The accommodation unit shall not be used as the sole or main residence of the occupiers. No person shall occupy any part of the accommodation for a period exceeding twelve weeks. Furthermore, no person shall occupy the accommodation within a period of eight weeks following the end of a previous period of occupation by that same person.
The reason for the condition is:-
To enable the local planning authority to retain control over the development which has been permitted, where the occupation of the development as full-time residential accommodation would result in a permanent residential dwelling in an unsustainable location and in a location which does not have a suitable environment or facilities for permanent residential occupation contrary to policies CS1, CS2 of the Core Strategy and GSP1, A1 and A2 of the Local Plan Part 2. |
5. | There shall be no use of the accommodation hereby permitted until the accommodation unit first been fitted with sound attenuation against external noise sufficient to ensure internal sound levels are no greater than:
a) 35dB LAeq (16 hour) in the main living rooms of the dwelling(s) (for daytime and evening use); and
b) 30dB LAeq (8 hour)/45dB LAmax (fast) in the bedrooms of the dwelling(s) (for night-time use) in line with World Health Organisation guidance, with windows shut and other means of ventilation provided.
The reason for the condition is:-
To ensure adequate living conditions for future occupiers and to achieve World Health Organisation guidance levels. |
6. | There shall be no use of the accommodation hereby permitted until the covered and secure cycle parking facilities and refuse storage areas have first been provided and made available for use in accordance with the details of a scheme to be first submitted to and approved in writing by the Local Planning Authority. The development shall be undertaken in accordance with the details as approved, and shall be retained as such thereafter.
The reason for the condition is:-
To ensure adequate living conditions and access to sustainable travel options. |
7. | The development shall be connected to the mains sewer network for the disposal of foul drainage from this development and there shall be no other means of foul drainage disposal. The development shall thereafter remain connected to the mains sewer network at all times.
The reason for the condition is:-
To ensure there is no detrimental impact on internationally protected wildlife sites arising from increased impacts on Nutrient Neutrality loading in the catchment of designated sites, in accordance with policies CS11 and GSP5, and to secure the mitigation required to allow the development to pass the Appropriate Assessment required by the Conservation of Species and Habitats Regulations 2017 (as amended). |
8. | INFORMATIVE NOTES - Please read the following notes carefully:-
Due to the close proximity of other residential dwellings and/or businesses, the hours of any construction or refurbishment works that are audible outside of the boundary of the site should be restricted to reduce the likelihood of noise disturbance to:
- 0730 hours to 1830 hours Monday to Friday;
- 0830 hours to 1330 hours Saturdays; and,
- No work on Sundays or Bank/Public Holidays. |
9. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £221.17 (received 26-09-24), and for off-site public open space provision and enhancement amounting to £1311.07 (received 10-10-24). |
