1.TIME LIMIT The development hereby permitted must be completed within SIX months from the date of this permission (*** waiting on confirmation of acceptance from applicants.***) The reason for the condition is:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004 and is for a shortened time limit as the fence is required to mitigate impacts on neighbouring amenity.
2.APPROVED DOCUMENTS AND DRAWINGS The development shall be carried out in accordance with the following plans and documents: - Site Location Plan, Drawing No. 23-0123-300 - Revised acoustic fence layout including return leg at eastern end, as shown on Drawing No. 23-0123-002 Rev A, received 23 February 2024 - Noise Impact Assessment, Report Ref: IEC/4526/01 AVH, dated 17 July 2023, prepared by Independent Environmental Consultancy Limited (iec), as amended by Technical Memorandum - Noise Impact Assessment, Memo Ref: IEC/R4526/01/AVH, dated 7 March 2024 increasing acoustic enclosure fence specification height to 4m high and fence to have a mass density of at least 26.4kg/m2, along with an absorbent lining. - Email from applicant confirming: 'fence height to be 4 metres and fence specification to be absorbent sound screen system 75mm thickness using Rockwool RW45 as the absorbent material with a black mesh protective sharkskin. The colour will be natural timber FSC certified treated and protected for 30-year life span. Utilising steel support posts due to fence height'. The reason for the condition is:- For the avoidance of doubt of what has been approved and to ensure the satisfactory development of the site.
3.VALIDATION OF NOISE MITIGATION / ADDITIONAL MITIGATION MEASURES Part A ) - Following completion of the noise mitigation measures hereby approved, a verification report shall be produced by a suitably qualified professional to demonstrate the effectiveness of the noise mitigation measures and to establish if internal noise levels within the nearest building, identified as Unit 4 (D) Munnings Court, Harfreys Road, Harfreys Industrial Estate, Great Yarmouth meets the required internal noise level of no more than 50dB (LAeq, 1 hour), and shall be submitted to and approved in writing by the Local Planning Authority. Part B ) - In the event that the verification report required in Part A above identifies any exceedance of the required noise level within the building as identified above, additional mitigation measures, including sound insulation lagging of of the compressor test pipework shall be completed within a timescale to be submitted and approved in writing by the Local Planning Authority. The sound insulation works shall be implemented as approved and retained thereafter. The reason for the condition is :- In order to prevent undue noise nuisance to occupiers of nearby buildings in accordance with Policy CS9f of the Core Strategy and Policies A1 and E6 of the Local Plan Part 2.
4.UNKNOWN CONTAMINATION In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified, and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by policy E6 of the Local Plan Part 2.
