1.The development shall be carried out in accordance with the following plans (unless otherwise varied in part by condition 2 below) - Received 12th July 2024: - Location Plan - Flood Response Plan - Noise Impact Assessment; ref. DYN120224A/1 Rev. 1 May 2024, and Received 30th May 2025: - Current rides and stalls schedule and images and site layout over view images, including landscaping and portacabin anchor system details The reason for the condition is:- For the avoidance of doubt of what has been approved and in the interests of proper planning.
2.Unless no changes are proposed to the approved rides and stalls schedule and site layout referred to in condition 1 above, by the 1st March of each year, a schedule of the rides and stalls to be used on the site and a proposed site uses and structures layout plan shall be submitted to the Local Planning Authority for its written approval, and the site shall be operated thereafter in accordance with those details as approved. The reason for the condition is :- For the avoidance of doubt and to enable the Local Planning Authority to retain control over the use of the site and in the interest of the amenities of the occupants of adjoining dwellings, as in accordance with policies CS9 of the Core strategy and A1 of Local Plan Part 2. This is also reflective of the applicants operations and the potential for updating of rides and attractions that may occur from time to time. NOTE: Care should be given to the choice of any future rides/stalls selected for the site to ensure that they do not cause a significant adverse noise impact to nearby residents. Particular care should be taken in regard to rides and structures situated 10m north of the dwellings adjacent to the south boundary.
3.Notwithstanding the provisions of Schedule 2, Part 18, Class B of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking and re-enacting that Order) (with or without modification) no mechanical amusements and/or side shows shall be provided on site other than those specifically included in the details approved in condition 1 or subsequently approved in condition 2. The reason for the condition is :- For the avoidance of doubt and to enable the Local Planning Authority to retain control over the use of the site and in the interest of the amenities of the occupants of adjoining dwellings, as in accordance with policies CS9 of the Core strategy and A1 of Local Plan Part 2. This is also reflective of the applicants operations and the updating of rides and attractions that occurs from time to time
4.The development shall be operated at all times in accordance with the Flood Evacuation Plan; received by the Local Planning Authority on the 12th July 2024. The reason for the condition is :- To minimise the risk to the occupants of the site in the event of flooding and to assist the emergency services and local authority during a flood event, as in accordance with policies CS13 and E1 of the Core strategy and Local Plan Part 2.
5.The Portacabin shall at all times be secured to the ground using the 4no. Portacabin Base Anchor System in accordance with the details supplied in the "Current Ride images and Layouts Site Over view images" Document received on the 30th May 2025, and correspondence received 19th July 2025. The reason for the condition is :- To ensure the portacabin remains in-situ should there be a flood event and to prevent damage to property and the wider environment, as in accordance with policies CS13 and E1 of the Core strategy and Local Plan Part 2.
6.The site shall not be open to customers outside of 10am - 8pm on any day. The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings, in accordance with policy CS09 of the Core Strategy and A1 of Local Plan Part 2.
7.There shall be no use of loudspeakers and / or public address systems within the site. The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings, in accordance with policy CS09 of the Core Strategy and A1 of Local Plan Part 2.
8.There shall be no use of external amplified music. The reason for the condition is :- To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings, in accordance with policy CS09 of the Core Strategy and A1 of Local Plan Part 2.
9.There shall be no installation of any external lighting whatsoever without the details first being submitted to and approved in writing by the Local Planning Authority. Any external lighting permitted shall be operated in accordance with the details as approved. The reason for the condition is : To ensure the use does not prejudice the residential amenities of the occupiers of nearby dwellings, in accordance with policy CS09 of the Core Strategy and A1 of Local Plan Part 2.
10.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) there shall be no gates, walls, fences or other means of enclosure erected without first obtaining the express written permission of the Local Planning Authority, other than that approved under Planning Permission ref: 06/22/0519/F. The reason for the condition is:- To enable the Local Planning Authority to retain control over the erection of any gates, walls, fences or other means of enclosure in the interests of residential amenity, highway safety and the character and appearance of the Conservation Area, in accordance with policies CS09, CS10 and CS16 of the Core Strategy and A1 and E1 of the Local Plan Part 2, as well as S66 and S72 of the Listed Buildings Act.
11.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) there shall be no impermeable hardstanding installed within the site without first obtaining the express written permission of the Local Planning Authority. The reason for the condition is :- To enable the Local Planning Authority to retain control over surfacing in the interests of visual amenity and flood risk, in accordance with policies CS09, CS13 and E1 of the Core strategy and Local Plan Part 2.
