1.The development shall be retained in accordance with the following plans, or unless stated below carried out and thereafter retained in accordance with these: - Location Plan ref. 101c - Block Plan ref. 102e (relating to the proposed agricultural building, surface water drainage, access, hardstanding and gates only) The following plan received on the 2nd October 2023; - Block Plan with Visibility Splays ref. 105 and the following plans received on the 21st August 2023; - Existing Elevations ref. 104 - Existing Floor Plans ref. 103. The reason for the condition is:- For the avoidance of doubt.
2.The building and ancillary hardstanding shall be used for agricultural use only; and for no other purpose. The reason for the condition is: To enable the local planning authority to retain control over any future changes of use of the application site in the interests of local amenities in accordance with Policy CS9 and CS11 of the Core Strategy, A1 of the Local Plan Part 2.
3.Within three months of the date of this decision the surface water drainage channel, route and storage tank as indicated on Drawing No. 102e shall be installed and shall be retained as such thereafter. It should be noted that it is the applicants/developers/owners responsibility to ensure adequate drainage of the site so as not to adversely affect surrounding land, property, highway and water environment. The reason for the condition is :- To minimise the possibilities of flooding and contamination in accordance with Policies CS13, E1 and E6.
4.Within three months of the date of this decision the vehicular access indicated on Drawing No.102e shall be upgraded in accordance with the Norfolk County Council access construction specification for the first 2.5m metres as measured back from the near channel edge of the adjacent carriageway the details to be agreed in writing by the Local Planning Authority. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway. The reason for the condition is: - To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety and traffic movement in accordance with Policy CS16.
5.The access gates shall be retained in position in accordance with the approved Drawing No.102e and hung to open inwards only. The reason for the condition is: - In the interests of highway safety enabling vehicles to safely draw off the highway before the gates/obstruction is opened in accordance with Policy CS16.
6.The visibility splays shall be provided and retained in full accordance with the details indicated on the approved plan Drawing No. 105. The splays shall thereafter be maintained at all times free from any obstruction exceeding 1.00 metres above the level of the adjacent highway carriageway. The reason for the condition is: - In the interests of highway safety in accordance with Policy CS16.
7.The proposed access, on-site parking/servicing/loading/unloading/turning/waiting area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan Drawing No.102e and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Policy CS16.
8.During the first planting season following the date of this approval, a native hedgerow (which shall comprise a double staggered row of native species) shall be planted on the raised bank along the southern boundary, and western boundaries, as indicated on Drawing 101c. Any planting which dies or is felled, uprooted, willfully damaged or destroyed within five years of the date of planting shall be replaced by the applicants or their successors in title. The reason for the condition is: - To ensure a satisfactory form of development and to enhance the visual amenities of the locality, and to comply with Policy CS11 (Core Strategy) and E4 (Local Plan Part 2).
9.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
10.This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing. It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer.
