1.The development must be begun not later than three years beginning with the date of this permission. Reason:- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority: Site Location Plan and Block Plan - drawing 8537 P03 Rev D, received on 16th October 2024 Proposed Elevations - drawing 8537 P02 Rev B, received on 30th August 2024. Reason:- For the avoidance of doubt.
3.The dwelling/s shall be constructed so as to provide sound attenuation against external noise and ensure internal sound levels no greater than: a) 35dB LAeq (16 hour) in the main living rooms of the dwelling(s) (for daytime and evening use); and b) 30dB LAeq (8 hour)/45dB LAmax (fast) in the bedrooms of the dwelling(s) (for night-time use), in line with World Health Organisation guidance, when measured with windows shut and other means of ventilation provided. Reason:- To ensure adequate living conditions for future occupiers and to achieve World Health Organisation guidance levels.
4.The development shall proceed in accordance with the requirements outlined in Preliminary Ecological Appraisal report (Practical Ecology; April 2024) and the recommendations outlined in the Bat Emergence and Re-entry surveys (arbtech; August 2024). Reason:- To avoid harming birds, bats and hedgehogs on site during the demolition of the existing dwelling and the construction of the replacement dwelling, in accordance with Core Strategy (2015) Policy CS11.
5.There shall be no construction above slab / DPC / foundations level until an Ecological Enhancement Strategy produced by a suitably qualified ecologist has first been submitted to and approved in writing by the local planning authority, detailing the enhancement measures for biodiversity on site as those outlined in the Preliminary Ecological Appraisal report (Practical Ecology; April 2024) and Bat Emergence and Re-entry surveys (arbtech; August 2024). The biodiversity enhancement plan should include numbers and locations of bird boxes, bat boxes, habitat enhancements. The measures shall be carried out strictly in accordance with the approved scheme. Reason:- To avoid harming birds, bats and hedgehogs on site during the demolition of the existing dwelling and the construction of the replacement dwelling, in accordance with Core Strategy (2015) Policy CS11.
6.The dwelling hereby permitted shall be built to meet requirement M4(2) of Part M of the Building Regulations for accessible and adaptable dwellings. Where it is not practicable to meet requirement M4(2) of Part M of the Building Regulations, a statement demonstrating where this is the case, and justifying any proposed inability to achieve the requirements of M4(2) of Part M of the Building Regulations, shall first be submitted to and approved in writing by the Local Planning Authority prior to any works being undertaken above slab/DPC/foundations level. The development shall thereafter be constructed in strict accordance with the details so approved. Reason:- To ensure that the dwellings are designed to be adaptable and efficient for lifetime occupation and to provide appropriate long term residential amenity in line with the requirements of the adopted Great Yarmouth Local Plan Part 2 (2021) Policy A2.
7.No construction above slab / DPC / foundations level of the new dwelling shall take place until a statement demonstrating how the dwelling will be designed and built to achieve a water consumption rate of no more than 110 litres/person/day has been first submitted to and approved in writing by the Local Planning Authority. All required water conservation measures within the approved details shall thereafter be installed and maintained to achieve this agreed rate, prior to the occupation of the dwelling, to ensure the required water consumption is not exceeded for the lifetime of the development. Reason: In the interests of promoting and securing water efficiency improvements to a higher standard than Building Regulations minimum standards require, to accord with adopted Local Plan Part 2 policy E7. Note to applicant - The imposition of this planning condition requires the development to achieve a higher standard of construction than the current minimum national requirement through Building Regulations. This requires you / the Developer to ensure that the standard is adhered to when seeking Building Regulations Completion Notice approval (whether using local authority inspectors or third party approved inspectors).
8.There shall be no occupation of the development hereby permitted until the proposed access/on-site car parking/turning area have first been laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. Reason: To ensure the permanent availability of the parking areas, in the interests of satisfactory development and highway safety; in accordance with Core Strategy (2015) Policy CS16.
9.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified, and, 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by policy E6 of the Local Plan Part 2.
10.Foul drainage shall not be discharged other than to the foul sewer which connects to the Anglian Water Caister Water Treatment Works. The details of the connection to the mains pipe shall be provided to and approved in writing by the Local Planning Authority before the development is first occupied. The reason for the condition is:- In order to effect satisfactory drainage arrangements from the site and to avoid problems of pollution of nearby water courses and/or harm to protected habitats which would impact upon Nutrient Neutrality.
11.No occupation of the dwellings hereby approved shall occur until details in written and drawn form of the means by which electric vehicle charging shall be made available for the development shall have first been submitted to and approved in writing by the Local Planning Authority. The charging provision shall be provided and made available for use prior to the first occupation of each dwelling in accordance with the approved details and shall be retained as such thereafter The reason for the condition is: - To ensure provision for the demand for electric vehicle charging within the development in accordance with Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
12.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order), no extensions or outbuildings shall be undertaken or erected within the site, and there shall be no alterations to or enlargements of the roof made, unless express planning permission has first been obtained from the local planning authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
13.REASON FOR APPROVAL OF THE APPLICATION: - The proposal meets the criteria of Local Plan Part 2 (2021) Policies H7 and A2.
14.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
15.It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £221.17 (received 13/12/2024) and for off-site public open space provision and enhancement amounting to £1,245.27 (received 06/12/2024).
