1.The development shall be undertaken in accordance with the following revised plan received by the Local Planning Authority on the 2nd February 2024: - Location and Site Plan: Drawing Reference 2337-01 The reason for the condition is:- For the avoidance of doubt.
2.The site shall only be used for the sale of fireworks between the 15th October and the 15th November and between the 27th December and the 31st December in any year. No sales of fireworks or any other form of retail shall take place from the site outside of these dates. The reason for the condition is :- The application site lies outside of retail centre and proposes a main town centre use and the application has not been supported by any information to suggest that a permanent retail use is acceptable here as would usually be required by Policy R1 of the Local Plan Part 2 (2021).
3.Any retail sales from the storage containers hereby approved shall operate by appointment only and shall serve no more that 2 customers at any one time. The applicant shall maintain a logbook detailing visitors to the site. The logbook shall be maintained in perpetuity and be available for officers from the Local Planning Authority to view at all reasonable times. The reason for the condition is :- To ensure that the number of visitors is retained to a suitable level to mitigate the intensity of the use and reduce pressure on parking, in accordance with Core Strategy Policy CS16 of the Core Strategy (2015).
4.Retail sales from the storage containers shall be restricted to the sale of fireworks only and for no other purpose. The reason for the condition is :- The application site lies outside of retail centre and proposes a main town centre use and the application has not been supported by any information to suggest that a permanent retail use, for sales wider than fireworks, is acceptable here as would usually be required by Policy R1 of the Local Plan Part 2 (2021).
5.Storage within the containers hereby approved shall be limited to the storage of fireworks only and for no other purpose. The reason for the condition is :- To ensure the intensity of the use, within the car park of an existing business, is suitably controlled and does not prejudice the use of the existing commercial unit in accordance with Core Policy CS06 of the Core Strategy (2015).
6.By the 31st August 2024, the on-site car parking shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan (Dwg No. 2337-01) and retained thereafter available for that specific use. The reason for the condition is :- To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Core Policy CS16 of the Core Strategy (2015)..
7.REASON FOR APPROVAL OF THE APPLICATION :- The limited retail aspect of this proposal is not considered to represent a significant conflict with policy R1 and CS07 and can be appropriately managed by way of condition.
8.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
