1.The development hereby approved shall be carried out in accordance with the forms and additional Floodlights information (Project code: 10728H dated 14 09 2018) submitted in support of the application and the following plans and details approved within permission 06/18/0533/F, unless stated otherwise: - Drawing No. 18-0496 BM22583 0370 02 revision 01 received by the Local Planning Authority on the 2nd January 2019 - Drawing No. S-75, 5433 no.11 rev B - Drawing No. 5433 no.10 rev C - Drawing No. 18-0496 BM22583 0370 04 revision 00 - Drawing No. 18-0496 BM22583 0370 06 - Drawing No. 18-0496 BM22583 0370 03 revision 00 and - Drawing No. S20-111DWG/0004.03 FENCING relating to amendment to fencing and boundary treatment details as approved by the Local Planning Authority within application 06/21/0098/F and, - Drawing No.'s S20-111 DWG 0000.01 FTP DESIGN and S20-111 DWG 0002.01 FTP ELEVATIONS relating to amendment to design for introduction of a third spectator stand along south western pitch perimeter as approved by the Local Planning Authority within application 06/21/0421/F and - Car Parking Policy prepared by East Norfolk Sixth Form College Dated September 2023 - Community Use Agreement prepared by East Norfolk Sixth Form College dated October 2023. The reason for the condition is :- For the avoidance of doubt.
2.The pitch, and club house may not be open or in use outside of the following hours: - 09:00 to 22:00 in any one day on Mondays to Fridays - 10:00 to 20:00 Saturday - 10:00 20:00 Sundays and Bank Holidays. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings in accordance with the submitted details and in accordance with policy A1 of the GYBC Local Plan.
3.Car and cycle parking provision in relation to Community Use - (whereby 'Community Use' shall mean the purposes defined in the Community Use Agreement to be implemented and operated in accordance with Condition 10 of this permission) of the artificial grass pitch shall be made available and retained thereafter in accordance with approved plan reference 18-0496 BM22583 0370 02 revision 01 received by the Local Planning Authority on the 2nd January 2019 and shall be operated and maintained in accordance with the approved Car Parking Policy prepared by East Norfolk Sixth Form Academy Dated September 2023 and received 25 September 2023, unless otherwise first agreed in writing by the Local Planning Authority. The reason for the condition is :- To ensure the permanent availability of the parking in the interests of satisfactory development and highway safety in accordance with GYBC Local Plan Policy CS16.
4.No loudspeaker, amplifier, relay or other audio equipment including musical instruments (whether acoustic or amplified) shall be installed or used in relation to use of the sports pitch. The reason for the condition is :- In the interests of the amenities of adjoining residents in accordance with policy A1 of the GYBC Local Plan.
5.Grounds maintenance shall not take place outside of the following hours: - 0730 hours to 1830 hours Monday to Friday - 0830 hours to 1330 hours Saturdays - No work on Sundays or Bank Holidays. The reason for the condition is :- In the interest of the amenity of occupiers of surrounding dwellings in accordance with policy A1 of the GYBC Local Plan.
6.The development shall at all times of use be operated in accordance with the Noise Management Plan prepared by East Norfolk Sixth Form Academy dated 23 11 2020 and approved by the Local Planning Authority as part of the Approval of Details decision, reference: 06/20/0656/CD. The reason for the condition is :- To ensure that noise is adequately managed from the commencement of the use to protect the amenity of nearby residential occupiers in accordance with policy A1 of the GYBC Local Plan.
7.The floodlighting shall be erected and to a luminance as described within the details submitted and shall remain at this luminance when on in perpetuity. The floodlighting shall not be on outside of the following times: - 09:00 to 23:00 in any one day Mondays to Fridays - 10:00 to 21:00 Saturday - 10:00 to 21:00 Sundays and Bank Holidays Being one hour after the use of the pitch is to cease. The reason for the condition is:- To ensure that the lighting is turned off an hour after the pitch is not in use in the interests of neighbouring amenity in accordance with policy A1 of the GYBC Local Plan.
8.All fencing and boundary treatments shall be erected in full in accordance with the approved details as shown on plan reference 18-0496 BM22583 0370 06 and 10-0496 BM22583 0370 04 as amended by Drawing No. S20-111DWG/0004.03 FENCING prior to commencement of the use hereby permitted and shall be retained in accordance with these details in perpetuity. The reason for the condition is:- To ensure the erection of sufficient fencing to the correct height and specification in the interests of neighbouring amenity in accordance with policy A1 of the GYBC Local Plan.
9.The design and layout of the pitch hereby approved shall be maintained in perpetuity in accordance with Drawing No.'s S20-111 DWG 0000.00 FTP DESIGN; S20-111 DWG 0001.00 FTP LAYOUT; and S20-111 DWG 0002.00 FTP ELEVATIONS approved under approval of details application ref: 06/20/0656/CD. The reason for the condition is :- To ensure the development is fit for purpose and sustainable and to accord with Sport England's Development Plan Policy.
10.Unless otherwise agreed in writing by the Local Planning Authority, the development hereby approved shall not be used otherwise than in strict compliance with the approved Community Use Agreement prepared by East Norfolk Sixth Form Academy dated October 2023. The reason for the condition is :- To secure well managed safe community access to the sports facility in accordance with the National Planning Policy Framework and to ensure sufficient benefit to the development of sport and to accord with Sport England's Development Plan Policy and GYBC Local Plan.
11.The floodlights shall be operated and maintained in accordance with the submitted Floodlighting details - Predicted Overspill Footprint Drawings (No. Vertical and Horizontal lux). If the lux levels are found to be above those on the Predicted Overspill Footprint Drawings then appropriate mitigation measures shall be carried out in agreement with the Local Planning Authority during the lifetime of their use. The reason for the condition is :- In the interests of protecting residential amenity in accordance with policy A1 of the GYBC Local Plan.
12.The floodlight poles hereby approved shall be maintained in a dark colour. The reason for the condition is :- To ensure that the appearance of the floodlights blends in with the character of the area, surrounding trees and green open space in accordance with Policy CS9 of the GYBC Local Plan.
13.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
