1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans and documents received by the Local Planning Authority on the 5th July 2023: - Site Plan, Proposed Floor Plan and Proposed Elevations, Drawing Ref: 1807/1 - Flood Risk Assessment prepared by Evans Rivers and Coastal (REPORT REF: 3210/RE/05-23/01) The reason for the condition is:- For the avoidance of doubt.
3.The materials to be used in the external walls and roof of the development hereby permitted shall match those of the existing building in accordance with the details stated in the application form. The reason for the condition is :- In the interests of the visual amenities of the area in accordance with Core Strategy (2015) Policy CS09.
4.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order (2015), as amended, the use of the building hereby permitted and extended shall only be used as offices (within Use Class E(g)(i), and for no other purpose (including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and reenacting that Order with or without modification). The reason for the condition is: To enable the Local Planning Authority to retain control over any future changes of use of the application site in the interests of: the vitality and viability of the Town Centre as set out in Local Plan Policies GY1 and CS07; Yarmouth Business Centre safeguarded employment area as set out in Local Plan Policy CS06; as other uses in Class E include main town centre uses for which this location is a sequentially inappropriate location.
5.No use of the extended building shall take place until such time that a Business Flood Response Plan, as set out in the Flood Risk Assessment, has been submitted to and approved in writing by the Local Planning Authority. The Business Flood Response Plan shall include ensuring the site is brought into the Environment Agency's Flood Warning Service, and shall include evacuation procedures. The Business Flood Response Plan shall be be made available to all of the site management and staff thereof. The development shall continue to be operated thereafter in accordance with the Business Flood Response Plan in perpetuity. The reason for the condition is :- To minimise the risk to the occupants in the event of flooding in accordance with Policy CS13 of the adopted Great Yarmouth Local Plan Core Strategy (2015).
6.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by policy E6 of the Local Plan Part 2.
7.REASON FOR APPROVAL OF THE APPLICATION :- The proposal provides a suitable use within a safeguarded employment area and the proposed extension is in keeping with the character and appearance of the building. The scheme complies with Core Policies CS01, CS02, CS6, CS09, CS13 and CS16 along with Local Plan Part 2 Policies GSP1, A1, B1 and E1.
