1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following plans received by the Local Planning Authority: - Drawing No. 02 Existing and Proposed Block Plan, Typical Elevation and Site Location Plan, received 28th April 2023 The reason for the condition is :- For the avoidance of doubt.
3.The materials to be used in the development hereby permitted shall match those specified in the application form and plans. The reason for the condition is :- In the interests of the visual amenities of the area in accordance with Policies CS9 of the adopted Great Yarmouth Core Strategy (2015), A1 of the adopted Great Yarmouth Local Plan Part 2 (2021) and Policy 2 of the adopted Fleggburgh Neighbourhood Plan (2022).
4.Any access gates/bollard/chain/other means of obstruction shall be hung to open inwards, set back, and thereafter retained a minimum distance of 6 metres from the near channel edge of the adjacent carriageway. The reason for the condition is: - In the interests of highway safety enabling vehicles to safely draw off the highway before the gates/obstruction is opened in line with policy CS16 of the adopted Great Yarmouth Local Plan Part 2 (2021).
5.Prior to the first use of the development hereby permitted a 2.4 metre wide parallel visibility splay shall be provided across the whole of the site's roadside frontage. The splay shall thereafter be maintained at all times free from any obstruction exceeding 0.6 metres above the level of the adjacent highway carriageway. The reason for the condition is: - In the interests of highway safety in accordance with the principles of the NPPF and in line with policy CS16 of the adopted Great Yarmouth Local Plan Part 2 (2021).
6.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
7.This proposal involves excavations adjacent to the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the Applicants' responsibility to ensure that,in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
8.It is the Applicant's responsibility to clarify the boundary with the public highway. Private structures such as fences, or walls will not be permitted on highway land.
