| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans:
- Site location plan (un-referenced drawing, dated 3 April 2023, scale 1:500)
- Site layout Plan (un-referenced drawing, dated 26 March 2023, scale 1:500)
- Details of boundary fencing (received 26 June 2023)

| 3. | There shall be no commencement of the use of the site for dog training and exercise until such time as the approved boundary / perimeter fencing as shown on the site layout plan has first been installed and which shall be retained as such thereafter for the duration of the use hereby permitted. No other forms of fencing or enclosure shall be installed whatsoever unless an appropriate planning application is first submitted to and approved by the Local Planning Authority.
The reason for the condition is :-
In the interests of visual amenity, to comply with policy CS09 of the Core Strategy. |
| 4. | The dog exercise facility shall not operate outside of the following hours:-
05:00 - 21:30 on any day from Monday to Sunday including Public and Bank Holidays.
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings, to comply with policy A1 of the Local Plan Part 2. |
| 5. | The dog exercise facility hereby approved shall accommodate no more than four dogs at any one time and shall operate by appointment only with at least a 15 minute gap between appointments. The applicant shall maintain a log book detailing visitors to the site. The log book shall be maintained in perpetuity and be available for officers from the Local Planning Authority to view at all reasonable times.
The reason for the condition is :-
In the interests of neighbouring amenity of nearby dwellings, to comply with policy A1 of the Local Plan Part 2; to mitigate changes of vehicle conflict on the access track and to ensure adequate availability of parking, in accordance with policy CS16 from the Core Strategy. |
| 6. | The secure dog training facility hereby approved shall not be used for dog training classes by more than four dogs at any one time and shall not operate outside of the following hours:-
- 09:00 to 18:00 on any day from Mondays to Saturdays
The use for dog training classes shall not take place on Sundays or Public and Bank Holidays.

| 7. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended (or any order modifying, reenacting or otherwise altering that order), there shall be no external lighting erected at the site unless an appropriate planning application is first submitted to and approved by the Local Planning Authority.
The reason for the condition is :-
To ensure protect the value of the landscape and its dark skies character and to limit light pollution in accordance with policy E6 of the Local Plan Part 2. |
| 8. | Prior to the first use of the development hereby permitted the proposed access, on-site car parking/turning areas shall be laid out and demarcated (in accordance with the approved plans) and be retained for that specific use. Parking for the secure dog training and exercise area shall be provided at all times sufficient for at least 4 vehicles.
The reason for the condition is: -
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Core Policy CS16. |
| 9. | There shall be no use of the site as a dog training or exercise facility until at least 1no. dog waste and litter bin(s) have first been provided and installed and made available for users of the site. The bins shall be emptied and maintained on a regular basis, and shall be retained as such thereafter.
The reason for the condition is :-
In the interests of ecological protection and public amenity, to comply with policy A1 of the Local Plan Part 2 and Core Strategy Policy CS11. |
| 10. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal provides a dog training and exercise facility which should off set some of the expected recreational demand on Designated Sites within the Borough. This is considered to outweigh the policy conflict of the loss of Grade 1 agricultural land. |
| 11. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
| 12. | NOTES - Please read the following notes carefully:-
Access to the site will be via the Public Right of Way known as Martham footpath 18 which does not offer any means of public vehicular access and it is not maintainable at the public expense to a vehicular standard. It would be expected that any damage caused to the footpath by the exercise of the private rights remains with the rights holders to repair.
The full legal extent of this footpath must remain open and accessible at all times for the duration of the development and subsequent occupation. |

On receipt of a flood warning or alert, the site users should follow the instructions received from the Environment Agency. |
