| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-

| 3. | Prior to the first occupation of the development hereby permitted the vehicular accesses shall be constructed in accordance with the highways specification (TRAD 1, attached) and thereafter retained at the position shown on the approved plan GC/410/02 Rev F Dec 23. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway.
The reason for the condition is :-
To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety in accordance with Policy CS16 of the Local Plan. |
| 4. | Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order (2015), (or any Order revoking, amending or re-enacting that Order) no gates/bollard/chain/other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved in writing by the Local Planning Authority.
The reason for the condition is :-
In the interests of highway safety in accordance with Policy CS16 of the Local Plan. |
| 5. | Prior to the first occupation of the development hereby permitted a 2.4 metre wide parallel visibility splay (as measured back from the near edge of the adjacent highway carriageway) shall be provided across the whole of the site's roadside frontage (West Road) in accordance with the approved plan GC/410/02 Rev F Dec 23. The splay shall thereafter be maintained at all times free from any obstruction exceeding 0.6 metres above the level of the adjacent highway carriageway.

In the interests of highway safety in accordance with Policy CS16 of the Local Plan. |
| 6. | Prior to the first occupation of the development hereby permitted the proposed accesses, /on-site car parking/turning areas shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is :-
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Policies CS16 and I1 of the Local Plan. |
| 7. | Notwithstanding the details indicated on the submitted drawings no works above slab level shall commence on site unless otherwise agreed in writing with the Local Planning Authority until detailed drawings for the off-site highway improvement works (footway/accesses) as indicated on Drawing No. GC/410/02 Rev F Dec 23 have been submitted to and approved in writing by the Local Planning Authority.
The highway improvement works shall be completed as approved prior to first occupation of any dwelling.
The reason for the condition is :-
To ensure that the highway improvement works are designed to an appropriate standard in the interest of highway safety and to protect the environment of the local highway corridor and to ensure that the highway network is adequate to cater for the development proposed in accordance with Policy CS16 of the Local Plan. |
| 8. | Prior to the first occupation of each dwelling, provision shall be made for a minimum 7Kw wired and working electric vehicle charger - either post or wall mounted. This shall be retained as such thereafter
The reason for the condition is :-
To ensure the development complies with Policy I1 of the Local Plan regarding charging of plug-in and other ultra low-emission vehicles in safe, accessible and convenient locations |
| 9. | The requirements for compliance with M4(2) as indicated on the approved drawings: Plot 1 and Cart shed plans and elevations - Drawing no. GC/410/03 Ref F Dec 23; and Plots 2, 3, 4 & 5 plans and elevations - Drawing no. GC/410/04 Rev D Dec 23 shall be completed prior to first occupation of each dwelling and shall be retained as such thereafter.
The reason for the condition is :-
To ensure functional, healthy and sustainable homes in accordance with Policy A2 of the Local Plan. |
| 10. | The development hereby approved shall be designed and built to achieve a water consumption rate of no more than 110 litres/person/day. All required water conservation measures installed to achieve this rate shall be retained/upgraded to ensure the required water consumption rate is not exceeded for the lifetime of the development.
The reason for the condition is :-
To ensure compliance with Policy E7 of the Local Plan. |
| 11. | The development shall be carried out in accordance with the Recommendations as specified in section 6 of the Desk Study and Risk Assessment" produced by Norfolk Partnership Laboratory dated October 2022
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by Policy E6 of the Local Plan. |
| 12. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.

| 13. | All imported topsoil and subsoil for use on the site shall either (a) be certified to confirm its source and that it is appropriate for its intended use or (b) in the absence of suitable certification, analysis of the imported material will be required along with evaluation against the derived assessment criteria for this site. No occupation of the development shall take place until a copy of the certification has been submitted to the Local Planning Authority.

To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by Policy E6 of the Local Plan. |
| 14. | Trees and hedgerows to be retained as indicated in the Arboricultural Impact Assessment, Tree Protection Plan, Method Statement together with Landscape Strategy Plan dated October 2023 prepared by C J Yardley Landscape Survey & Design LLP, shall be protected in accordance with the details specified in section 3 - Arboricultural Implications Assessment with landscape strategy plan
and section 4 - Method Statement in relation to Trees; and Appendix Tree Protection Plan no. 4816/01/Rev A dated 2 October 2023.
The reason for the condition is :-
To ensure retention of the tree and hedgerow features that contribute to the character of the site and surroundings in accordance with Policy E4 of the Local Plan. |
| 15. | The proposed development shall be carried out in accordance with the recommendations outlined in section 5 of the Preliminary Ecological Appraisal (PEA) (BiOME Consulting; September 2022) and in particular the biodiversity enhancement measures as identified in section 5.6 shall be provided for each dwelling, prior to first occupation, in terms of a single bat box, single bird box - swift and/or sparrow, and ground level gaps in fencing to enable movement by hedgehogs and shall be retained as such thereafter.
The reason for the condition is :-
In order to benefit biodiversity and enhance the natural environment in accordance with Policy CS11 of the Local Plan. |
| 16. | The means of surface water drainage shall be carried out in accordance with the following details [prior to the first occupation] and shall be retained as such thereafter:

It should be noted that it is the applicants/developers/owners responsibility to ensure adequate drainage of the site so as not to adversely affect surrounding land, property or highway.
The reason for the condition is :-
To minimise the possibilities of flooding in accordance with Policy CS13 of the Local Plan. |
| 17. | All planting, seeding or turfing comprised in the approved details contained in the Arboricultural Impact Assessment, Tree Protection Plan, Method Statement together with Landscape Strategy Plan dated October 2023 prepared by C J Yardley Landscape Survey & Design LLP, as indicated on Appendix Landscape Strategy Plan no. 4816/03Rev A shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever, is the sooner, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
The reason for the condition is:-
In the interests of the visual amenities of the locality in accordance with Policy E4 of the Local Plan. |
| 18. | The development shall be carried out in accordance with Existing and Proposed levels - Drawing no. GC/410/5 Rev D Jan 24, and for the avoidance of doubt ground levels shall not be raised in the garden of Plot 1 above the 'existing levels' as specified thereon..
The reason for the condition is :-
In order to avoid the displacement of surface water and to allow for flood storage in the event of a flood in accordance with Policy CS13 of the Local Plan |
| 19. | The under floor void beneath Plot 1 shall be constructed in accordance with Plot 1 and Cart shed plans, under floor void and elevations - Drawing no. GC/410/03 Ref F Dec 23, and shall be maintained for its lifetime in accordance with the Void Maintenance Plan contained in Appendix A in Flood Risk Assessment December 2023 Ref: 3355/RE/12-23/01 by Evans River and Coastal Ltd.
The reason for the condition is :-
In order to avoid the displacement of surface water and to allow for flood storage in the event of a flood in accordance with Policy CS13 of the Local Plan |
| 20. | The flood event action plan and safe access/egress route as contained in section 4.3 of the Flood Risk Assessment December 2023 Ref: 3355/RE/12-23/01 by Evans River and Coastal Ltd shall be made available to future occupiers of Plot 1.
The reason for the condition is :-
In accordance with the recommendations of the flood risk assessment, to minimise the risk to the occupants in the event of surface water flooding in accordance with Policy CS13 of the Local Plan. |
| 21. | The first floor side windows on Plots 2, 3, 4 & 5 plans and elevations - Drawing no. GC/410/04 Rev D Dec 23 shall be fitted with obscure glass to a level equivalent to Pilkington Privacy Level 5 which shall be installed prior to the first occupation of the dwellings and this obscure glazing shall be retained thereafter in perpetuity.
The reason for the condition is:-
In the interests of the residential amenities of the occupiers of nearby properties in accordance with Policy A1 of the Local Plan. |
| 22. | No dormer windows or other openings in the roof space shall be provided in the east elevation of Plot 1. (Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order, revoking, re-enacting or modifying that order)).
The reason for the condition is:-
To help safeguard the privacy and amenity of the occupiers of adjacent properties in accordance with Policy A1 of the Local Plan. |
| 23. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £1054.20 received 12 Dec 2023 and for off-site public open space provision and enhancement amounting to £6271.45 received 11 Dec 2023. |

It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. This development involves work to the public highway that can only be undertaken within the scope of a Legal Agreement between the Applicant and the County Council. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained; typically this can take between 3 and 4 months. Air Quality- Construction:
The site will potentially generate a significant amount of dust during the construction process; therefore, the following measures should be employed:
- An adequate supply of water shall be available for suppressing dust;
- Mechanical cutting equipment with integral dust suppression should be used;
- There shall be no burning of any materials on site, or burial of asbestos, which should instead be removed by an EA licenced waste carrier, and the waste transfer notes retained as evidence. |

Asbestos Note:
The developer is reminded that prior to any refurbishment commencing on site the building/s to be refurbished are required to be surveyed for the presence of asbestos containing materials in accordance with the Control of Asbestos Regulations 2012. Any asbestos containing materials which
are identified shall be managed or removed in accordance with the above regulations and waste regulations. Failure to comply with these regulations could result in prosecution by the relevant authority.
The uncontrolled refurbishment of buildings could result in the contamination of soils on site and in the vicinity of the demolition. This could cause the investigation of the site under Part 2A of the Environmental Protection Act 1990, which may result in the determining of the site as Contaminated Land.
