1.Condition 3 states: - "Foul drainage shall not be discharged other than to the foul sewer which connects to the Anglian Water Caister Water Treatment Works in accordance with the information provided by e-mail dated 5th July 2022. The details of the connection to the mains pipe shall be provided before the development is first occupied. The reason for the condition is:- In order to effect satisfactory drainage arrangements from the site and to avoid problems of pollution of nearby water courses and/or harm to protected habitats which would impact upon Nutrient Neutrality." Decision: This condition is hereby discharged in PART only. Whilst the amended written submission details have been considered suitable, the Condition still requires the development to ensure that all foul drainage is discharged into the Anglian Water network. The development must be undertaken in accordance with the following details hereby approved: - Drawing 7934 P03 Revision Y dated 27.09.23 - Proposed Site Plan, proposed levels, landscaping, boundary treatment and bat boxes, received by the Local Planning Authority on 28 September 2023.
2.Condition 4 states: - "Notwithstanding the submitted documentation, no work whatsoever shall commence on the barn conversion until a full precise schedule of works for the barn conversion has been submitted to and approved in writing by the Local Planning Authority. The schedule shall include: a) details of the construction, materials and finishes of all new doors and windows including finishes; b) all items to be retained and removed; c) all building repairs; d) all new joinery; e) details of all other materials and finishes to be used in the development. The development shall be carried out in accordance with the approved details and materials. If any rebuilding is required the existing bricks shall be reused with repointing to be undertaken with lime mortar to ensure that the character and appearance of the building is retained. Any additional infill brickwork required shall be reclaimed brick and those to be used shall first be agreed as samples and in writing with the Local Planning Authority. The reason for the condition is :- In the interests of the protection of the building to be converted and the visual amenities of the area and notwithstanding the submitted schedule which is not comprehensive enough in this instance, in accordance with Policies CS9 and CS10 of the adopted Great Yarmouth Core Strategy (2015) and Policies A1 and E5 of the adopted Great Yarmouth Local Plan Part 2 (2015)." Decision: This condition is hereby discharged in PART only. Whilst the amended written submission details have been considered suitable, the Condition still requires the development to be undertaken in accordance with the following approved details: - Document entitled: "Barn conversion Schedule of Works" dated September 2023, Revision E, received by the Local Planning Authority on 28th September 2023. - Proposed External Material List, dated September 2023, received by the Local Planning Authority on 28th September 2023.
3.Condition 5 states: - "Prior to any works on the barn conversion hereby permitted, a copy of the relevant Bat Mitigation Low-Impact Licence for the works hereby approved shall be submitted to and approved in writing by the Local Planning Authority. The development shall only be carried out in accordance with all of the recommendations for mitigation and compensation set out in the Mitigation Licence which details the methods for retaining the conservation status of bats unless varied by a European Protected Species licence subsequently issued by Natural England; details of which shall be submitted to and approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure the protection of bats in accordance with Policy CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015)." Decision: This condition is hereby discharged in PART only. Whilst the amended written submission details have been considered suitable, the Condition still requires the development to be undertaken in accordance with the following approved details: - Email from Natural England confirming the necessary Bat Licence to be in place, received by the Local Planning Authority on 28 April 2023.
4.Condition 6 states:- "There shall be no development beyond slab level until a scheme that demonstrates how the dwellings will be built to meet requirement M4(2) of Part M of the Building Regulations for accessible and adaptable dwellings, where practicable, has first been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be constructed in strict accordance with the details as approved. The reason for the condition is :- To ensure that the dwellings are designed to be adaptable and efficient for lifetime occupation and to provide appropriate long term residential amenity." Decision: This condition is hereby discharged in PART only. Whilst the amended written submission details have been considered suitable, the Condition still requires the development to be undertaken in accordance with the following approved details: - Document entitled: 'Building Regulations Document M - Volume 1 Category 2 - Accessible and adaptable dwellings - Achieving compliance', dated March 2023, received by the Local Planning Authority on 29 March 2023.
5.Condition 7 states:- "There shall be no development beyond eaves level of any of the dwellings shown as Units 1 - 6 shown on Plot Boundary Plan L01-F until details, including an up-to-date Tree Survey, Tree Belt Management Plan, and a Tree Planting Plan have first been submitted to and approved in writing by the Local Planning Authority. The planting and tree management proposals shall show regard to the possible implications on neighbouring dwellings from the retention of large evergreen trees and shall propose replacement native species where appropriate, and the development and tree management processes shall thereafter be undertaken in strict accordance with the details as approved and shall be undertaken in accordance with the timescales therein. This is notwithstanding the submitted documents including Drawing Number 7934 P03 Revision I. The reason for the condition is :- For the protection of the trees, planting and amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021)." Decision: This condition is hereby discharged in PART only. Whilst the amended written submission details have been considered suitable, the Condition still requires the development to be undertaken in accordance with the following approved details: - Document entitled: 'Boundary Management Report and Proposed Trees' by BH Trees and Woodland, referred to as Arboricultural Report Version 3.0, dated 28 September 2023, received by the Local Planning Authority on 28th September 2023; and, - Drawing 7934 P03 Revision Y dated 27.09.23 - Proposed Site Plan, proposed levels, landscaping, boundary treatment and bat boxes, received by the Local Planning Authority on 28 September 2023 (with the exception of the planting proposals notes on that same plan).
6.Condition 11 states:- "No development shall take place within the area outlined in red on the attached plan entitled "Further archaeological mitigation areas (red)", dated 3 January 2023, until an archaeological report and a suitable second phase of mitigation has first been undertaken and submitted to and approved in writing by the Local Planning Authority. The reason for the condition is :- For the protection of archaeological artefacts in accordance with Policy CS10 of the adopted Great Yarmouth Local Plan Core Strategy (2015) and the National Planning Policy Framework (2021), in particular paragraph 205." Decision: This condition is hereby discharged in FULL. The following documents have been approved: - Document entitled: 'Addendum to the Written Scheme of Investigation for a Programme of Archaeological Mitigatory Work: Works Under Archaeological Supervision and Control', Revision A, dated February 2023 HES Ref: CNF48443, received by the Local Planning Authority on 29 March 2023. - Document entitled: 'Record of Informative Trial Trenching', Revision A, dated January 2023 HES Ref: CNF48443, received by the Local Planning Authority on 29 March 2023. Advisory Note - The applicant is reminded that Condition 13 remains in place and requires discharging and the applicant is advised to ensure the Local Planning Authority receives the approved final report on the archaeological fieldwork and post-excavation analysis, publication and confirmation of archiving.
7.Condition 12 states:- "No works above slab level shall take place until a statement demonstrating how the dwellings will be designed and built to achieve a water consumption rate of no more than 110 litres/person/day has been first submitted to and approved in writing by the Local Planning Authority. All required water conservation measures within the approved details shall thereafter be installed and maintained to achieve this agreed rate to ensure the required water consumption is not exceeded for the lifetime of the development. The reason for the condition is: - In the interests of promoting and securing water efficiency improvements to a higher standard than Building Regulations minimum standards require, to accord with adopted Local Plan Part 2 policy E7. Note to applicant - The imposition of this planning condition requires the development to achieve a higher standard of construction than the current minimum national requirement through Building Regulations. This requires you / the Developer to ensure that the standard is adhered to when seeking Building Regulations Completion Notice approval (whether using local authority inspectors or third party approved inspectors)." 8.Condition 15 states:- "Prior to the first occupation of the development hereby permitted, the vehicular access shall be constructed in accordance with a detailed scheme to be first submitted to and approved in writing by the Local Planning Authority in accordance with the highways specification, and thereafter shall be retained at the position shown on the approved plan. Arrangement shall be made for surface water drainage to be intercepted and disposal of separately so that it does not discharge from or onto the highway. The reason for the condition is :- To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway in the interests of highway safety in accordance with Policy CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015)." 9.Condition 18 states:- "No occupation of the dwellings hereby approved shall occur until details in written and drawn form of the means by which electric vehicle charging shall be made available for the development shall have first been submitted to and approved in writing by the Local Planning Authority. The charging provision shall be provided and made available for use prior to the first occupation of each dwelling in accordance with the approved details and shall be retained as such thereafter. The reason for the condition is: - To ensure provision for the demand for electric vehicle charging within the development in accordance with Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021)." 10.Condition 22 states:- "No external lighting shall be erected unless full details of its design, location, orientation and level of illuminance have first been submitted to and agreed in writing with the Local Planning Authority. Such lighting shall be kept to the minimum necessary for the purposes of security and site safety and shall prevent upward and outward light radiation. The lighting shall thereafter be implemented accordance with the approved details and shall be retained as such thereafter. The reason for the condition is: - In the interests of ensuring that biodiversity measures are not impacted and residential amenity is not adversely affected, in accordance with Policies CS9 and CS11 of the adopted Great Yarmouth Core Strategy (2015) and Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021)."
