1.Due to the proximity and height of the proposed balcony, the development creates a raised outdoor amenity space which could be directly viewed from No. 2 Rye Gardens to the immediate east of the site, this would result in an unacceptable loss of amenity to the residents of the adjoining property through overlooking and the loss of privacy and through increased activity facilitated by the balcony leading to an increase in noise and disturbance to the said occupiers. Therefore, the application is contrary to Core Policy CS09 and Local Plan Part 2 Policies A1 and H9 which both seek to protect the amenity of neighbours.

3.STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way and where possible has sought solutions to problems to achieve the aim of approving sustainable development. Unfortunately, despite this, in this particular case the development is not considered to represent sustainable or an acceptable form of development and has been refused for the reasons set out above.
