1.Condition 3 requires that an asbestos survey is submitted by the applicant to and approved in writing by the Local Planning Authority. The application was supported by the following document: - Refurbishment / Pre-demolition survey of Asbestos Materials at Pamela's Restaurant and Garage ECI dated 15 July 2022) The submitted document is sufficient to discharge condition 3 in full.
2.Condition 4 requires that a contaminated land report submitted by the applicant to and approved in writing by the Local Planning Authority. The application was supported by the following document: - Phase 1 Contaminated Land Assessment (Canham Consulting Ref: 218008; dated 17th October 2022) The submitted document is sufficient to discharge condition 4 in full.
3.Condition 7 requires details of the bin storage area to be submitted to and approved in writing by the Local Planning Authority and for the bin storage area to be installed prior to the occupation of the units. The application was supported by the following document: - Bin and cycle storage details (unnumbered plan) The submitted document is sufficient to discharge Condition 7 in part. The condition cannot be discharged in full because the condition requires that the bin storage area be installed prior to the first occupation of the units. The development must take place in accordance with the approved details.
4.Condition 8 requires details of bird boxes to be submitted to and approved in writing by the Local Planning Authority and for the bird boxes to be installed prior to first occupation. The application was supported by the following documentation: - Drawing 1506/2 Rev.A(April'23)1/Swift Boxes added - Reference Image of Madrid Swift Nest Box The condition cannot be discharged in full because the condition requires that the bird boxes be installed prior to the first occupation of the units. The development must take place in accordance with the approved details.
5.NOTES - Please read the following notes carefully:- With regard to Condition 3: Asbestos Your attention is drawn to the possibility that the building(s) may have been constructed with materials that contain asbestos. Legal Requirements If the work involves the removal of loose asbestos, asbestos insulation board (AIB), or lagging; it is a legal requirement that this is done by an HSE licensed contractor. Works involving the removal of asbestos cement sheet, articles containing asbestos such as some types of floor tile, or textured wall coatings does not have to be done by an HSE licensed contractor. However, any contractor working with these materials must comply with the Control of Asbestos at Work Regulations 2002. Guidance on how to comply with these regulations can be found on the HSE web site www.hse.gov.uk Waste materials containing asbestos have to be disposed of in accordance with the requirements of the Control Of Pollution (Special Waste) Regulations 1980.
