| 1. | The development shall be carried out in accordance with the following plans and documents received by the Local Planning Authority on the 4th May 2023:

| 2. | No occupation of the development hereby permitted shall occur until such time that full details of a soft landscaping scheme has first been submitted to and approved in writing by the Local Planning Authority.
The precise details of the landscaping proposals shall include:
- full specifications of all new planting along with details for their protection during establishment.
For the avoidance of doubt, all species used in the planting proposal shall be locally native species of local provenance.
The reason for the condition is :-
Because the precise details have not been submitted and in the interests of the satisfactory visual amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021). |
| 3. | The approved planting scheme secured by Condition 2 of this permission shall be carried out in its entirety within the first planting and growing season following the first occupation of the dwelling to which the planting relates. For the duration of a period of 10 years from the first occupation of the dwelling, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species.
The reason for the condition is :-
To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity in accordance with Policies CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015) and Policy A2 of the adopted Great Yarmouth Local Plan Part 2 (2021). |
| 4. | No occupation of the development hereby permitted shall occur until such time that the vehicular access indicated for improvement on Drawing No. CL01-S-01 001 Rev. A1 has been widened to a minimum width of 6.8 metres in accordance with the Norfolk County Council residential access construction width of the public highway (footway) as measured back from the near channel edge of the adjacent carriageway. Arrangement shall be made for surface water drainage to be intercepted and disposed of separately so that it does not discharge from or onto the highway carriageway.
The reason for the condition is: -
To ensure construction of a satisfactory access and to avoid carriage of extraneous material or surface water from or onto the highway interests of highway safety and traffic movements; in accordance with Policies CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 5. | No occupation of the development hereby permitted shall occur until no fewer than 2no. sparrow terrace boxes have been installed on the dwelling hereby permitted. The sparrow terrace boxes shall remain thereafter in perpetuity.
The reason for the condition is :-
To ensure that the application complies with core policy CS11 of the Core Strategy (2015). |
| 6. | Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order (2015), (or any Order revoking, amending or re-enacting that Order) no gates/bollard/chain/other means of obstruction shall be erected across the approved access unless details have first been submitted to and approved in writing by the Local Planning Authority.
The reason for the condition is: -
In the interests of highway safety, in accordance with Policies CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 7. | No occupation of the development hereby permitted shall occur until such time that visibility splays have been provided in full accordance with the details indicated on the approved plan (CL01-S-01 Rev A1). The splay shall thereafter be maintained at all times free from any obstruction exceeding 1.0 metres above the level of the adjacent highway carriageway.
The reason for the condition is: -
In the interests of highway safety in accordance with Policies CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 8. | No occupation of the development hereby permitted shall occur until such time that the proposed access, on-site car parking and turning area has been laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use.
The reason for the condition is: -
To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety, in accordance with Policies CS16 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 9. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any amendment revoking or re-enacting that Order) the dwelling hereby permitted shall not be further extended in any way without first obtaining the express written permission of the Local Planning Authority.
The reason for the condition is:-
To enable the Local Planning Authority to retain control over any further extensions to the dwelling in the interests of residential amenity, in accordance with Policy CS09 of the adopted Great Yarmouth Local Plan Core Strategy (2015) and Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021). |
| 10. | The dwelling shall be of single storey construction and notwithstanding the provisions of the Town and Country Planning, (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no dormer windows or other openings to the roofspace shall be provided without first obtaining the express written permission of the Local Planning Authority.
The reason for the condition is:-
In the interests of the residential amenities of the occupiers of adjacent residential properties, in accordance with Policy CS09 of the adopted Great Yarmouth Local Plan Core Strategy (2015) and Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021). |
| 11. | There shall be no occupation of the development hereby approved until such time that the Electric Vehicle Charging Point shown on plan CL01-S-01 Rev A1 has first been installed and made available for use. The EV charging point shall thereafter be maintained and retained and replaced only where necessary to still ensure the dwelling is afforded an EV charging point.
The reason for the condition is :-
To provide the required EV charging in accordance with Local Plan Part 2 (2021) policy I1. |
| 12. | There shall be no occupation of the development hereby approved until such time that the dwelling has first been fitted with the water efficient appliances and services proposed to be necessary to achieve the water efficiency standard set out in the submitted 'BRE global water efficiency calculator' document submitted to the Local Planning Authority on the 4th May 2023. The fittings and services shall thereafter be maintained and retained and replaced only where necessary to still ensure the dwelling achieves a sufficient standard able to achieve the efficiency rate of no more than 108 litres per person per day as presented in the submitted document.
The reason for the condition is :-
To achieve the required water efficiency set out in Local Plan Part 2 (2021) policy E7. |
| 13. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by policy E6 of the Local Plan Part 2. |
| 14. | The garage (also referred to as storage building) hereby permitted and shown on plan CL01-P-03 Rev A1 shall only be used for the garaging of vehicles and for private domestic storage only. No commercial storage or activities shall take place from the garage.
The reason for the condition is :-
For the avoidance of doubt and in the interests of the residential amenities of the occupiers of adjacent properties (in accordance with policies CS09 and A1) and in the interests of highways safety and minimising traffic impacts because the access to the parking court and manoeuvring within it are restricted (in accordance with policy CS16). |
| 15. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal does provide a dwelling within a sustainable location. It does not present any greater harms than the previously approved (an part implemented) dwelling and therefore is considered acceptable. |
| 16. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £210.84 received (£185.93 received on the 24/03/23 and the top up of £29.91 received on the 14/06/23) and for off-site public open space provision and enhancement amounting to £1,254.29 (received 23/06/23). |

Great Yarmouth Borough Council has a duty to ensure that roads and streets within the Borough are properly named and that the properties fronting onto them are appropriately numbered. Therefore it is essential that once planning permission has been granted, and prior to the completion of development, the developer/owner applies for an official address. This Authority has adopted the legislation set out in sections 17, 18 and 19 of The Public Health Act 1925. In common with most neighbouring local authorities, Great Yarmouth Borough Council is introducing charging for the street naming and numbering of new developments from the 1st January 2020. | 18. | NOTES - Please read the following notes carefully:-
This development involves works within the public highway that can only be carried out by Norfolk County Council as Highway Authority unless otherwise agreed in writing.
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway
Authority. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council.
