| 1. | There shall be no occupation of the dwelling hereby permitted until the construction of the dwelling within the development hereby permitted has first been undertaken fully in accordance with the revised plans listed below.
In the event that occupation of the dwelling hereby permitted has already begun by the date of this grant of permission, within three months of the date of this permission the rear elevation first floor shall be completed and constructed to remove the balcony which was originally proposed, and shall be finished in strict accordance with the details within the revised plans listed below, dated 2nd November 2023 and received by the Local Planning Authority on 10th November 2023:

The rear elevation first floor window as shown on on the approved elevation shall be fitted with none other than obscure glass with an obscurity rating of at least Pilkington Level 5 obscurity, which shall be fitted no later than three months of the date of this permission, and shall be retained as such thereafter.
The reason for the condition is:-
For the avoidance of doubt and in the interests of the protection of neighbouring residential amenity. |
| 2. | Use of the static caravan / mobile home within the development hereby permitted for residential purposes shall be undertaken only for the purposes of providing temporary accommodation during the construction of the replacement dwelling hereby permitted, and its occupancy shall be limited to that of the owner(s)/resident of San Toi and immediate family. The use for residential purposes shall cease immediately upon the first use of the main dwelling known at the date of this permission (for the avoidance of doubt) as San Toi, St Marys Road, Hemsby, and shall not at any time be resumed for residential purposes for the duration of its being stationed within the application site.
The reason for the condition is :-
To ensure that a second residential use is not introduced to the site whilst there are insufficient facilities or living standards for occupants of the caravan / mobile home, and to minimise the impacts on amenity of residents of the main dwelling. It is also necessary to prevent continued residential use of the mobile home in the interests of not increasing the risk to residents from coastal erosion as the site adjoins the identified Coastal Change Management Area, and because the development has not made provision for addressing the recreational impacts on internationally protected wildlife sites nor made contributions to public open space facilities in the area. |
| 3. | Notwithstanding the existing arrangements on site, details of the hardstanding/car parking, refuse/cycle storage shall be submitted to and approved in writing by the Local Planning Authority within 1 month of the date of this planning permission, and the approved details shall thereafter be implemented prior to first occupation of the dwelling or within two months of the date of the approval of such details in the event that occupation has already begun.
The reason for the condition is :-
To ensure that sufficient off street car parking and servicing arrangements are provided on site. |
| 4. | There shall be no use of the dwelling hereby permitted for anything other than occupancy as a private dwellinghouse and for no other purpose whatsoever, including alternative use as a holiday let, air B&B or other temporary accommodation or occupancy, without first gaining the express written permission of the Local Planning Authority.
The reason for the condition is :-
To prevent loss of a dwelling house to holiday accommodation in accordance with the objectives of the Hemsby Neighbourhood Plan. |
| 5. | There shall be no use of the static caravan / mobile home within the development hereby permitted for anything other than as a use incidental or ancillary to the use of the private dwellinghouse, and for no other purpose whatsoever, including alternative use as a holiday let, air B&B or other temporary accommodation. The retained mobile home shall not be sold or leased separate to the main dwelling known at the date of this permission (for the avoidance of doubt) as San Toi, St Marys Road, Hemsby, for the duration of its being stationed within the application site.
The reason for the condition is :-
To ensure the use is appropriate to the character and function of the area, to ensure that a second residential use is not introduced to the site whilst there are insufficient facilities or living standards for occupants of the caravan, and to minimise the impacts on amenity of residents of the main dwelling. It is also necessary to prevent the residential use of the caravan / mobile home in the interests of not increasing the risk to residents from coastal erosion as the site adjoins the identified Coastal Change Management Area, and because the development has not made provision for addressing the recreational impacts on internationally protected wildlife sites nor made contributions to public open space facilities in the area. |
| 6. | Notwithstanding the provisions of Schedule 2 Classes A-F of Part 1 of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended, no alterations, amendments, enlargements or extensions to the dwelling shall be carried out without first gaining the express written permission of the Local Planning Authority.
The reason for the condition is :-
To provide the Local Planning Authority with control over further development on site in the interests of protecting the amenity of neighbouring dwellings. |
| 7. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
| 8. | NOTES - Please read the following notes carefully:-
The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: -
- An adequate supply of water shall be available for suppressing dust;
- Mechanical cutting equipment with integral dust suppression should be used;
- There shall be no burning of any materials on site. |
| 9. | The application site lies adjacent to the Coastal Change Management Area boundary as shown in the Council's Local Plan Maps. Please be advised that these line are anticipated to be reviewed and updated from 2024 and may be subject to change, potentially identifying the area as being at greater coastal erosion risk or subject to quicker rates of erosion than is currently understood to be the case. Please carefully consider this before completing and occupying the works hereby approved. |
