| 1. | The proposed garage is to be sited forward of the main dwelling. Whilst it could give rise to loss of light to the host dwelling at ground and first floor levels to the west, the proposal would visually detract from, and be out of character with, the form and character of area and this part of the street scene due to the absence of garages forward of their host dwellings. As a result, the proposal fails to comply with Policy CS9 of the adopted Great Yarmouth Core Strategy (2015) and Policy H9 of the adopted Great Yarmouth Local Plan Part 2 (2021). |
| 2. | By virtue of the height, siting, proximity, scale and mass of the proposed garage to the adjacent bungalow, which is situated at a lower ground level, the proposal would appear dominant, overbearing and obtrusive to the occupiers of the bungalow. In addition, it would also overshadow the neighbouring property and create a loss of light, which would have a detrimental impact, particularly to the habitable room at the front of the bungalow. As a result, the proposed garage fails to comply with Policy CS9 of the adopted Great Yarmouth Core Strategy (2015) and Policies A1 and H9 of the adopted Great Yarmouth Local Plan Part 2 (2021) and Paragraphs 130 and 134 of the NPPF (2021). |
| 3. | STATEMENT OF POSITIVE ENGAGEMENT (REFUSALS): In accordance with the NPPF, in determining this application for planning permission, the Borough Council has approached it in a positive and proactive way. However, the proposed garage is considered unacceptable and there would be no other location for it to be acceptable nor would a reduced scale or design overcome the matters. As a result, in this particular case the development is not considered to represent an acceptable form of development and has been refused for the reasons set out above. |
