1. | The development is carried out in accordance with the approved details within a period of 5 years from the date of this approval.
The reason for the condition is:-
In accordance with Condition B.2 (ix)(aa) of Schedule 2, Part 11, Class B of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). |
2. | No demolition shall take place until a Demolition Management Plan containing a detailed noise and dust management plan/scheme to protect the surrounding residential area from noise, dust and smoke, has been submitted to, and approved in writing by the Local Planning Authority.
The scheme shall include:
a. Communication with neighbours before and during works.
b. Contact arrangements by which residents can raise any concerns and, issues.
c. The mechanism for investigation and responding to residents' concerns and complaints
d. Management arrangements to be put in place to minimise noise and dust (including staff training such as toolbox talks).
e. Hours during which noisy and potentially dusty activities will take place.
f. Measures to control loud radios on site.
g. As far as practically possible, the measures to be taken to ensure noisy activities take place away from residential premises.
h. Measures to control dust from vehicle movements such as site speed limits, cleaning of site roads and wetting of vehicle routes in dry weather.
i. Measures to minimise dust generating activities on windy and dry days
j. That there shall be no burning activities taking place on site.
k. Method statements and risk assessments relating to the identification, removal and disposal of any asbestos containing materials which are present on site.
The approved plan shall remain in place and be implemented throughout each phase of the development.
Reason for the condition:
In the interests of the amenities of the locality and to comply with the requirements of Schedule 2, Part 11, Class B of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). |
3. | NOTES - Please read the following notes carefully:-
The proposed demolition is covered by the Building Act 1984 and a separate application under the Building Act is required. This permission shall not be taken as to convey, confer or imply permission for demolition under the Building Act or the requirements thereof. |
4. | This relates to demolition works only and does not relate to any redevelopment of the site or extraction of foundations. |
5. | Due to the close proximity of other residential dwellings and businesses, the hours of any construction or refurbishment works should be restricted to reduce the likelihood of noise disturbance to:
0730 hours to 1830 hours Monday to Friday
0830 hours to 1330 hours Saturdays
No work on Sundays or Bank Holidays. |
6. | The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance e.g. demolition or piling, together with contact details in the event of problems. |
7. | The developer is reminded that a survey for the presence of asbestos containing materials in accordance with the Control of Asbestos Regulations 2012 is required. Any asbestos containing materials which are identified shall be managed or removed in accordance with the above regulations and waste regulations. Failure to comply with these regulations could result in prosecution by the relevant authority.
Without adequate control of asbestos, it could cause contamination of the land and the investigation of the site under Part 2A of the Environmental Protection Act 1990, which may result in the determining of the site as Contaminated Land.

8. | This proposal involves works that could affect the public highway. It is an OFFENCE to carry out any works that may affect the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary consents or approvals under the Highways Act 1980 and the New Roads and Street Works Act 1991 are also obtained from the County Council. 9. | If, during development, contamination not previously identified is found to be present, then no further development shall be carried out until a scheme has been submitted to and approved by the Council detailing how this contamination shall be dealt with in accordance with a remediation scheme. Only when evidence is provided to confirm the contamination no longer presents an unacceptable risk, can development continue. |
