1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority: - Proposed Floor Plans and Elevations and Sections, drawing number 2022/1577/03, received 19th January 2023; - Site and Location Plans - drawing number 2022/1577/02 revision A, received 30th March 2023. The materials to be used in the construction of the annex building shall be in accordance with those materials specified on the approved drawings. The reason for the condition is :- For the avoidance of doubt.
3.The annex accommodation hereby permitted shall only be used as accommodation ancillary to and in association with the dwelling known as 1 Beccles Road, Belton, Great Yarmouth, NR31 9JQ. The annex accommodation hereby permitted shall only be used by the occupier of the dwelling and his immediate family and shall not be used as a separate dwelling or let separately for holiday purposes. The reason for the condition is :- The annex has sufficient rooms to form a dwelling or holiday let, the use as which may not be appropriate in this location outside of a defined settlement limit, and so the use is controlled to ensure the development is appropriate to the location, its lack of accessibility and to ensure there is appropriate amenity and facilities for existing and future users of the existing dwelling and the development hereby approved, in accordance with policies CS2, CS09 and CS16 of the adopted Great Yarmouth Core Strategy (2015) and GSP1, A1, H9, H10 and I1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
4.With the exception of the works to demolish the front boundary wall, there shall be no commencement of demolition of the garden room nor construction of the extensions or annex building hereby permitted until the details of an Arboricultural Method Statement and Tree Protection Plan have first been submitted to and approved in writing by the Local Planning Authority, sufficient to protect and preserve the hedges and trees adjacent the site on the northern boundary. The development shall thereafter be undertaken in strict accordance with the tree protection measures which shall be installed prior to the commencement of works and retained for the duration of the development demolition and construction period in accordance with the approved details. The reason for the condition is :- In the interests of protecting the visual amenity of the area, maintaining and preserving landscape assets and ecological value, and protecting biodiversity, in accordance with Policies CS09 and CS11 of the adopted Great Yarmouth Core Strategy (2015) and Policy E4 and A2 of the adopted Great Yarmouth Local Plan Part 2 (2021).
5.The materials to be used in the external walls and roof of the northern extension to the north of the existing dwelling's kitchen shall match those of the existing dwelling in terms of the colour and materials used, unless express permission is otherwise first specifically granted for any variation thereof. The reason for the condition is :- The details of proposed materials for this part of the development have not been specified in the application or on the approved plans and the condition is imposed to ensure the extensions are harmonious and complementary to the existing dwelling in contrast to the modern materials to be used in the attached annex facility, in the interests of the visual amenities of the area.
6.With the exception of demolition of the garden room, there shall be no commencement of construction of the annex building hereby permitted until the curved wall of the existing garden frontage has first been removed and appropriate visibility splay provided sufficient to ensure construction vehicles can access and egress the site without supervision. The visibility splay shall remain in place for the duration of construction works. The reason for the condition is :- In the interest of highway safety in line with paragraph 111 of the NPPF, Policy CS16 of the adopted Great Yarmouth Core Strategy (2015) and Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
7.There shall be no residential use or occupation of the annex building hereby permitted until the amended permanent visibility splay with set back brick wall adjacent the access gates, and the parking and turning areas have all first been constructed in accordance with the details shown on revised layout plan 2022/1577/02 revision A, received 30th March 2023. The facilities shall thereafter remain available for use and the visibility splay shall thereafter be retained and remain maintained as such in perpetuity. The reason for the condition is :- In the interest of highway safety and ensuring that vehicles can manoeuvre and leave the site in forward gear, in line with paragraph 111 of the NPPF, Policy CS16 of the adopted Great Yarmouth Core Strategy (2015) and Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
8.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. CONFIRMATION OF RECEIPT OF FINANCIAL CONTRIBUTION MITIGATION MEASURES: It is hereby acknowledged that the application has been accompanied by the appropriate and necessary financial contributions for GIRAMS Habitat Impacts Mitigation amounting to £185.93 received 18.01.2023, sufficient to address the Habitats Regulations Assessment (HRA). The accompanying shadow HRA report submitted by the applicant has been assessed as being suitable for the Borough Council as competent authority to use as the HRA record for the determination of the planning application, in accordance with the Conservation of Habitats and Species Regulations 2017.
