1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the plans received by the Local Planning Authority: - Location Plan - Drawing Number 2149-CS-001 Rev 02 - Received 6th April 2023 - Proposed Site Plan - Drawing Number 2149-CS-019 Revision 03 - Received 6th April 2023 - Proposed Ground Floor Plan and Roof Plan - Drawing Number 2149-CS-010 Rev 001 - Received 16th January 2023 - Proposed Elevations - Drawing Number 2149-MM-014 Rev 001 - Received 16th January 2023 - Proposed Cold Room Unit Plan and Elevations - Drawing Number 2149-CS-011 Rev 001 - Received 25th January 2023 - Fencing Treatment Elevations and Detail - Drawing Number 2149-CS-015 Revision 01 - Received 6th April 2023 The reason for the condition is :- For the avoidance of doubt.
3.The materials to be used in the development hereby permitted shall match those on the plans and application form. The reason for the condition is :- In the interests of the visual amenities of the area in accordance with Policy CS9 of the adopted Great Yarmouth Core Strategy (2015) and Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
4.There shall be no installation of any mechanical extraction or ventilation gear, plant or machinery, flue or fume treatment system, to the exterior of the building, without first gaining the express written permission of the Local Planning Authority. The details to be submitted in a planning application pursuant to this requirement shall include: the system design and appearance; positioning in and on the building(s); proposed noise emissions data and noise mitigation proposals; odour extraction and emission points and odour treatment systems; and, a schedule for the regular maintenance of the systems proposed. Any approved system(s) shall thereafter be installed strictly in accordance with the details as approved, which shall be maintained and retained as such thereafter in accordance with the details as approved, and the restaurant shall only operate concurrently with these systems in place and operational. The reason for the condition is :- In the interests of protecting and maintaining the amenity of residential and/or holidaymaking occupants of the caravans in the vicinity of the development, and in the interests of the visual amenity of the area, in accordance with Policy CS09 of the adopted Great Yarmouth Core Strategy (2015) and Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
5.(a) The development hereby permitted shall not be brought into use before 10:00 (10am) on any day, and shall be closed and activities at the site shall cease by 22:00 (10pm) each day. (b) Further to part (a) of this condition, the development hereby permitted shall not be made available for use by, nor undertake sales to, the public before 11:00 (11am) on any day, and shall be closed to the public and cease trading no later than 21:00 (9pm) each day. The reason for the condition is :- In the interests of protecting and maintaining the amenity of residential and/or holidaymaking occupants of the caravans in the vicinity of the development, in accordance with Policy CS09 of the adopted Great Yarmouth Core Strategy (2015) and Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
6.The development hereby permitted shall not be made available to any customers other than those resident as holidaymakers of the holiday park known as Caister Holiday Centre (or successors in title), or their bona fide guests, or employees and contractors of the holiday park. Customers to the restaurant must at all times be required to display evidence of their current association with the holiday park. The reason for the condition is :- The proposal has been presented, considered and assessed as a facility to serve the occupants of the surrounding Caister Holiday Park only, and the highways implications have been considered acceptable on that basis alone. The restriction is imposed in the interests of highway safety in the area in accordance with Policy CS16 of the adopted Great Yarmouth Core Strategy (2015) and Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021), and any proposed wider public use should be the subject of a suitable planning application.
7.INFORMATIVE NOTES: Fire Safety Standards: The Applicant's attention is drawn to the guidance provided in the Fire Service's Informative Note visible within the application online, dated 14/02/2023. Trade Waste: The applicant is advised that businesses require a Trade Waste contract to dispose of all waste associated with commercial activities as stated in the Environmental Protection Act 1990, Section 34. Advertisements: The applicant is advised that no signage or advertisement should be installed until express planning permission and/or advertisement consent has first been granted where necessary, including those proposals within the submitted plans.
