| 1. | Part (a) - Development comprising installation of any new outdoor gym equipment into the school grounds in the location hereby permitted shall be undertaken within 3 years beginning with the date of this permission.
Part (b) - Where it is the applicant's intention to provide the outdoor gym equipment in the approved location as a relocation of existing equipment sited in a currently unauthorised location, this shall be undertaken no later than 6 months from the date of this permission.
The reason for the condition is:-
Part (a) is imposed pursuant to Section 51 of the Planning and Compulsory Purchase Act 2004, and part (b) is imposed as a shorter time period for commencement in order to minimise the impacts on residential amenity and remove the unauthorised development in the most expedient manner possible without needing to rely on the use of a formal planning enforcement notice. |
| 2. | The development shall be carried out in accordance with the following revised plans received by the Local Planning Authority on 15th August 2023:
- Revised Block Plan labelled "Lynn Grove Academy - Outdoor Gym Block Plan revised 14.08.2023";
- Revised Site Location Plan ref: QRQM23086141552671;
- Revised Site Layout Plan showing area dimensions and equipment arrangement, ref: 'Lyn Grove Academy'.
The reason for the condition is:-
For the avoidance of doubt and to protect the amenity of neighbouring residents bordering the school, and to ensure there is no detrimental impact on the available use of sports pitches. |
| 3. | PART (A) -
Within 6 months of the date of this planning permission the existing gym equipment positioned along the eastern boundary of the applicant's wider area of control will be removed from its current location and shall thereafter be either:
(i) relocated in accordance with the approved plans stated in condition 2 above; or
(ii) removed from the site altogether.
PART (B) -
The area of land used for the siting of the currently unauthorised gym equipment shall thereafter be immediately restored to its former condition as playing field and/or sports pitch within 1 month of the relocation or removal of the unauthorised equipment.
The reason for the condition is :-
In the interests of protecting the residential amenities of the occupiers of nearby dwellings and to maintain the provision of sports facilities and preserve the enjoyment of existing sport and recreational facilities on site. |
| 4. | There shall be no use whatsoever of any of the unauthorised outdoor gym equipment located along the eastern boundary of the applicant's wider area of control until such time as the equipment has been removed and relocated to the location approved within this grant of planning permission. The equipment in its unauthorised location shall also be secured in such a way as to prevent any general access thereto and use thereof outside of the school operating hours, until such time as it is relocated or removed from the site altogether in accordance with the requirements of Condition 3 of this permission.
The reason for the condition is :-
To protect the amenity of adjoining residential neighbouring dwellings. |
| 5. | Construction work shall not take place outside the following hours:-
08:00 to 18:00 Mondays
08:00 to 18:00 Tuesdays
08:00 to 18:00 Wednesdays
08:00 to 18:00 Thursdays
08:00 to 18:00 Fridays
08:30 to 13:30 Saturdays
and no work shall take place on Sundays or Bank Holidays.
(These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property)
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 6. | REASON FOR APPROVAL OF THE APPLICATION :-
In its revised form and subject to the conditions required, the proposal meets the criteria for alterations and extensions to buildings set out in Policies CS9 and CS15 of the adopted Core Strategy and Policies C1 and A1 of the Local Plan Part 2 adopted 2021. |
| 7. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
| 8. | It is recommend that the applicant to conduct a site security review to ensure the perimeter security of the site is free from gaps (as it is a natural boundary) to prevent any anti-social behaviour and trespassing onto site as equipment like this can be draw for youths outside of school hours.
