1.The development (including external materials) shall be carried out in accordance with the following revised plans received by the Local Planning Authority on the 6th February 2022: Proposed Floor Plans: 19-1543-03B Proposed Elevations: 19-1543-05B and in accordance with the Site Location Plan: 19-1543-02 submitted as part of planning application 06/21/1006/F on the 21st December 2021. The reason for the condition is:- For the avoidance of doubt.
2.With the exception of the part demolition of the existing dwelling, no works above slab level shall take place until a scheme to demonstrate how the dwelling will be designed and built to provide electric vehicle charging has been first submitted to and approved in writing by the Local Planning Authority. All electric vehicle charging points within the approved details shall thereafter be installed prior to occupation of the replacement dwelling, and shall be retained and maintained as such. The reason for the condition is: - In the interests of providing electric vehicle charging points, to accord with adopted Local Plan Part 2 policy I1.
3.With the exception of the part demolition of the existing dwelling, no works above slab level shall take place until a scheme to demonstrate how the dwelling will be designed and built to achieve a water consumption rate of no more than 110 litres/person/day has been first submitted to and approved in writing by the Local Planning Authority. All required water conservation measures within the approved details shall thereafter be installed and maintained to achieve this agreed rate to ensure the required water consumption is not exceeded for the lifetime of the development. The features shall thereafter be retained in accordance with the approved details. The reason for the condition is: - In the interests of promoting and securing water efficiency improvements to a higher standard than Building Regulations minimum standards require, to accord with adopted Local Plan Part 2 policy E7. Note to applicant - The imposition of this planning condition requires the development to achieve a higher standard of construction than the current minimum national requirement through Building Regulations. This requires you / the Developer to ensure that the standard is adhered to when seeking Building Regulations Completion Notice approval (whether using local authority inspectors or third party approved inspectors).
4.No occupation of the dwelling hereby approved shall occur until the proposed access/on-site car parking area has first been laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety.
5.No occupation of the dwelling hereby approved shall occur until at least 2 sparrow terrace boxes have first been installed in their entirety on an external building wall or tree placed at least 2 metres above ground level. The bird boxes shall be retained in the approved form for the lifetime of the development. The reason for the condition is :- To secure biodiversity enhancements in line with the NPPF and the expectations of Core Policy CS11.
6.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: 1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and 2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
7.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. (These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property) The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings.
8.All planting, seeding or turfing comprised in the approved details of landscaping (as shown on location plan: 19-1543-02) shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. The reason for the condition is:- In the interests of the visual amenities of the locality.
9.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria of adopted policies A1, A2 H8, E4, E5, E7 and I1 from the Local Plan Part 2 and core policies CS09, CS10 and CS11 from the adopted Core Strategy
10.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
11.NOTES - Please read the following notes carefully:- The site will potentially generate a significant amount of dust during the conversion process; therefore, the following measures should be employed: - - An adequate supply of water shall be available for suppressing dust; - Mechanical cutting equipment with integral dust suppression should be used; - There shall be no burning of any materials on site.
12.NOTES - Please read the following notes carefully:- The applicant is reminded that they have a legal duty to remove most Asbestos Containing Materials (ACMs) before development and some ACMs must be removed by contractors licensed by the Health and Safety Executive. If at any stage during the development asbestos is suspected the work should be stopped and the material investigated.
