| 1. | The agricultural barn hereby permitted is hereby approved only on the basis of being constructed in accordance with the following plans (drawing ref: 30-002 (Block Plan) and 30-003 (Elevations)) received by the Local Planning Authority on 14 December 2022.

| 2. | The containers hereby permitted shall be laid out and positioned only in accordance with the following approved plans (drawing ref: 30-002 Block Plan and 30-004 and 30-005 Elevations) received by the Local Planning Authority on the 14 December 2022.

For the avoidance of doubt and in the interests of visual amenity. |
| 3. | The agricultural barn the subject of this permission shall be used only for the purposes of agricultural practices or the storage of materials and supplied associated with the activities of the farm known as Highfield Farm, Heath Road, Rollesby, NR29 5HJ and for no other purpose whatsoever.
The reason for the condition is:-
For the avoidance of doubt to ensure the development operates as proposed and in the manner considered by the Local Planning Authority, and to ensure the development complies with adopted local development plan policy in accordance with the nature of the development proposed in this countryside location. |
| 4. | There shall be no more than 28no. storage containers installed or stationed at the site at any one time, notwithstanding the existing or future provisions of Schedule 2 Part 4 Class B of the Town and Country Planning (General Permitted Development)(England) Order 2015, as amended, modified or revoked.

| 5. | All items stored within the site as defined by Location Plan 30-001 and Block Plan 30-002 shall be stored within the structures hereby approved, and for the avoidance of doubt there shall be no external storage of materials outside of these structures, unless otherwise first agreed in writing by the Local Planning Authority.

| 6. | The storage containers hereby approved shall not be opened/accessed outside of the following hours:-
· 09:00 to 17:00 Mondays to Saturdays
· 10:00 to 15:00 Sundays and Bank and Public Holidays.

In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 7. | The storage containers hereby approved shall only be used for storage purposes.
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 8. | Within 3 months of the date of the planning permission hereby granted, the mitigation and biodiversity enhancement measures outlined within section 5 and Appendices 1 and 2 of the Protected Species and Habitats Scoping Survey report (JP Ecology; December 2022) shall be implemented in full and shall be retained in accordance with those details thereafter. No further works shall be undertaken without the express approval of the Local Planning Authority.

| 9. | Within 1 month of date of the planning permission herby granted details of no less than 2no. bird boxes, 1 no. bat box and 1 no. owl box to be installed within the site shall be submitted to and approved in writing by the Local Planning Authority. These approved details shall be implemented within 2 months of the date of the approval by the Local Planning Authority of the said details and these details and the bird boxes shall remain and be maintained as such in perpetuity.

| 10. | No hazardous, toxic or poisonous substances shall be stored within the site at any given time. In addition, none of the following items shall be stored within the site at any given time:
- Combustible or flammable materials or liquids such as gas, paint, petrol, oil or cleaning solvents;
- Firearms, explosives, weapons or ammunition;
- Chemicals, radioactive materials, biological agents, toxic waste and asbestos;
- No item that emits any fumes, smell or odour;
- Compressed gas.

In the interests of protecting residential amenity and the surrounding countryside. |
| 11. | No external lighting whatsoever shall be installed without the express permission of the Local Planning Authority.
The reason for the condition is: -
In the interests of highway safety and residential amenity. |
| 12. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the aims of Core Policies CS01, CS06 and CS09 from the adopted Core Strategy and Policy B1 of the adopted Local Plan Part 2, and does not conflict with policies of the Rollesby Neighbourhood Plan.
INFORMATIVE NOTES TO THE APPLICANT AND DEVELOPER: -
1. Trade Waste -
The applicant is advised that businesses require a Trade Waste contract to dispose of all waste associated with commercial activities as stated in the Environmental Protection Act 1990, Section 34.
2. Ecology and Protected Species -
Nesting birds should not be disturbed during the nesting season typically 1st March to 31st August (species dependant).
Advice must be sought from an ecologist if any protected species are inadvertently disturbed.
The site owner has a responsibility to ensure that protected species or their resting places are not killed, injured or disturbed as a consequence of their actions.
Whilst the results of the survey are considered to be conclusive at the time that the survey was conducted, there is always a possibility that protected species might occupy the site between the period of the survey and the commencement of any works on the site. If any protected species are discovered whilst undertaking any works, works should cease until the ecologist has provided suitable protections or mitigation measures. |
| 13. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
