1. | The development must be carried out within a period of five years from the date of this permission.
The reason for the condition is :-
The condition is imposed in order to comply with the requirements of paragraph 2 (vi) of part A.2 of part 6 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015. |
2. | The development shall be carried out in accordance with the application form and the following plans:
a) Drawing Number 1, entitled Location Plan, dated 05.12.22;
b) Drawing Number 2, entitled Floor Plans and Elevations, dated 12.11.21.
The reason for the condition is:-
For the avoidance of doubt. |
3. | The building shall be used for the purposes of agriculture but shall not be used for the accommodation of livestock, or for the storage of slurry or sewage sludge, or for housing a biomass boiler or an anaerobic digestion system, or for the storage of fuel or waste from that boiler or system, nor for housing a hydro-turbine, unless express planning permission has first been granted in writing by the Local Planning Authority for that use(s).
The reason for the condition is :-
To comply with Condition A.2-(1) (a) of Class A of Part 6 to Schedule 2 of of the Town and Country Planning (General Permitted) (England) Order 2015 (as amended) because the development is within 400 metres of the curtilage of a protected building and would not benefit from permitted development allowances were it to have been proposed to be used for livestock and which could give rise to a number of issues that should be explored and assessed through a planning application. |
4. | If the extraction of any mineral from the land is required, the mineral shall not be moved off the agricultural unit.
The reason for the condition is :-
To comply with Condition A.2-(1) (b) of Class A of Part 6 to Schedule 2 of of the Town and Country Planning (General Permitted) (England) Order 2015 (as amended) because the development is within 400 metres of the curtilage of a protected building. |
5. | Waste materials shall not be brought on to the land from elsewhere for deposit except for use in works for the erection of the building and any materials shall be incorporated into the building.
The reason for the condition is :-
To comply with Condition A.2-(1) (c) of Class A of Part 6 to Schedule 2 of of the Town and Country Planning (General Permitted) (England) Order 2015 (as amended) because the development is within 400 metres of the curtilage of a protected building. |
6. | If the use of the building hereby permitted for the purposes of agriculture within the unit permanently ceases within 10 years from the date on which the development was substantially completed and planning permission has not been granted on an application, or has not been deemed to be granted under Part 3 of the Act for development for purposes other than agriculture within 3 years from the date on which the use of the building for the purposes of agriculture within the unit permanently ceased, the building shall be removed from the land and the land must, so far as is practicable, be restored to a condition to be submitted to, and agreed in writing, by the Local Planning Authority.

7. | Within 7 days of the date on which the building is substantially completed, the applicant/owner/developer shall notify the Local Planning Authority in writing of this.
The reason for the condition is :-
To comply with Condition A.2-(5) of Class A of Part 6 to Schedule 2 of of the Town and Country Planning (General Permitted) (England) Order 2015 (as amended) because the development is within 400 metres of the curtilage of a protected building. |
8. | The means of access to, and egress from, the building hereby permitted shall be derived only from the access shown on Drawing Number 1 Location Plan (dated 05.12.22).
The reason for the condition is :-
In the interests of highway safety and traffic movement. |
9. | There shall be no connection made from this building into a foul drainage system (either to the mains drainage or private treatment works/package treatment works), unless express planning permission has first been granted in writing by the Local Planning Authority for that connection(s).
The reason for the condition is :-
The site lies within the Nutrient Neutrality catchment area and would need to be assessed if foul drainage disposal would be required. The building applied for does not require foul drainage disposal. |
10. | NOTES - Please read the following notes carefully:-
Prior Approval is required for the demolition of any existing buildings which would need to be demolished to allow for the development, before they are demolished, before this development is able to proceed. Please note that granting prior approval for this development does not mean Prior Approval for the demolition of the buildings will be granted. |
11. | If, during development, contamination not previously identified is found to be present, then no further development shall be carried out until a scheme has been submitted to and approved by the Council as Local Planning Authority detailing how this contamination shall be dealt with in accordance with the remediation scheme as set out above. Only when evidence is provided to confirm the contamination no longer presents an unacceptable risk, can development continue. |
12. | The applicant is strongly recommended to advise neighbouring businesses and residential occupiers of the proposals, including any periods of potentially significant disturbance, together with contact details in the event of problems. |
13. | Due to the close proximity of other residential dwellings and businesses, the hours of any construction or refurbishment works should be restricted to:
0730 hours to 1830 hours Monday to Friday
0830 hours to 1330 hours Saturdays
No work on Sundays or Bank Holidays. |
14. | Please refer to the letter from the Broads Drainage Board, dated 11/01/2023 attached to this Decision Notice, as Land Drainage Consent may be required. |
