| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans:
. Location Plan received 11th November 2022
. Flood Risk Assessment (Evans Coastal 3125/RE/01-23/01) received 17th January 2023.
. Proposed Floor Plan (unnumbered) 14th March 2023
The reason for the condition is :-
For the avoidance of doubt. |
| 3. | Notwithstanding both the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order) and the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to Class E in any statutory instrument revoking and re-enacting that Order with or without modification, the premises shall only be used as a cafe under Class E(b) as being "for the sale of food and drink principally to visiting members of the public where consumption of that food and drink is mostly undertaken on the premises" and for no other purpose whatsoever.
The reason for the condition is :-
To enable the Local Planning Authority to retain control over the use of the premises as the use is considered to be a main town centre use in an out-of-centre location and has not gone through the sequential approach required by policy R1. |
| 4. | Prior to installation of any plant; machinery; ventilation; air conditioning; heating; extraction equipment, including any replacements of such, full details including location, acoustic specifications, and specific measures to control noise and odour from the equipment, shall be submitted to and approved in writing by the Local Planning Authority. The equipment shall be installed, used and retained in full working order thereafter in full accordance with the approved details.
The reason for the condition is :-
In the interests of visual and neighbouring amenity and as any harm to the adjacent Conservation Area resulting from such installations have not been considered as part of this application. |
| 5. | The premises shall not be open for business outside of the following hours:-
08:00 till 18:00 Monday to Saturday
The reason for the condition is :-
In the interests of the residential amenities of the occupiers of nearby dwellings. |
| 6. | There shall be no use of the cafe hereby permitted until all staff and operatives have first been made aware of the requirements to comply with the flood response measures set out in the submitted Flood Risk Assessment (reference (3125/RE/01-23/01). The contents of the Flood Response plan shall thereafter be maintained and retained in accordance with those submitted details for the duration of the development.
The reason for the condition is :-
In the interests of mitigating the impacts from any flood event. |
| 7. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal meets the requirements of policy R7. |
| 8. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
