No.Condition Text
1.The requirement to provide submitted details for Condition 22 has been fully discharged. A phasing plan proposal has been submitted to discharge Condition 22 parts (i) and (ii) concerning the existing turning head and the proposed extent of adoptable highway if the turning head is removed, and these are accepted as ensuring a Traffic Regulation Order process and replacement adoptable highway is not required at this stage, because the phased nature of the development hereby proposed does not require details pursuant to this permission. Sufficient information to discharge Condition 22 parts (iii) and (iv) have been submitted and is approved. Those submitted details address policies CS14, CS16 and GY10 and are considered acceptable. The extended road beyond the current limits of South Denes Road, and the new turning head at the end of that extension, shall therefore be constructed in accordance with the details herein approved for condition 22 parts (iii) and (iv), in accordance with the following details: - Letter dated 15 July 2022, ref: CES/PU2918/DC/Con22, received by the Local Planning Authority on 04 November 2022; - 79505-WSP-XX-ZZ-DR-GA-001 rev P03 - General Arrangement Plan; - 79505-WSP-XX-ZZ-DR-CV-0002 rev T02 - Layout Plan (sheet 2 of 3); - 79505-WSP-XX-ZZ-DR-CV-0003 rev T01 - Layout Plan (sheet 3 of 3); - 79505-WSP-XX-ZZ-DR-CV-0602 rev T01 - Vertical Alignment Longsections; - 79505-WSP-XX-ZZ-DR-CV-0603 rev T01 - Alignment 1 Cross Sections; - 79505-WSP-XX-ZZ-DR-CV-0604 rev T01 - Alignment 2 Cross Sections; - 79505-WSP-XX-ZZ-DR-CV-0611 rev T01 - Proposed Levels and Earthworks (sheet 2 of 3); - 79505-WSP-XX-ZZ-DR-CV-0612 rev T01 - Proposed Levels and Earthworks (sheet 3 of 3); - 79505-WSP-XX-ZZ-DR-CV-1101 rev T02 - Kerbs, Footways and Paved Areas (sheet 2 of 3); - 79505-WSP-XX-ZZ-DR-CV-1102 rev T02 - Kerbs, Footways and Paved Areas (sheet 3 of 3); - 79505-WSP-XX-ZZ-DR-CV-1201 rev T02 - Traffic Signs and Lines (sheet 2 of 3); - 79505-WSP-XX-ZZ-DR-CV-1202 rev T02 - Traffic Signs and Lines (sheet 3 of 3); - 79505-WSP-XX-ZZ-DR-SD-0001 rev T01 - Typical Cross Sections; - 79505-WSP-XX-ZZ-DR-D-SK06 rev P01 - Vehicle Tracking for Double Decker Bus; - NCC-WSP-XX-XX-FS-C-036 rev P02 - Highway Layout with Turning Head Vehicle Tracking; and, - Email from Kate Dinis received 05 June 2023 13:40 confirming there is no intention at this stage to submit a Traffic Regulation Order application to stop-up the adopted South Denes Road turning head, but this would be addresses if future phases required the turning head removal. NOTES TO APPLICANT AND DEVELOPER: (i) The existing turning head and South Denes Road must remain open and must not be closed to public use until the approved turning head shown on the Proposed Site Layout drawing within this development has first been constructed and made available for use. Planning permission would likely be required in advance of an alternative use or redevelopment of the existing turning head land, and any such proposals should be discussed with the Local Planning Authority at that appropriate time. (ii) Removing the existing turning head will require a Traffic Regulation Order to be agreed. For completeness, the developer and applicant are asked to provide the LPA with a copy of the final details of any Stopping Up Traffic Regulation Order at the relevant time. (iii) The applicant is reminded that the Highway Authority does not appear to have assessed the proposed construction details against their standards for prospective adoption, because it is said that at this stage the proposed new road and the land would remain a non-adopted road and the Highway Authority stated they did not wish to uphold the discharge of Condition 23 which requires the same information as that required in relation to the alternative turning head details here. Although this Condition 22 does not require the development offered for adoption, it does require the construction details to satisfy adoption standards. The details have been worked up in consultation with the Highway Authority and is thought to use the highway authority's standard construction designs, so is considered to address the condition. Notwithstanding the absence of a formal confirmation from the Local Highway Authority, it is considered that the details proposed satisfy the principle aims of the condition, will ensure that appropriate HGV and public transport access, pedestrian and cycle connectivity, and servicing can be provided through the development. (iv) The applicant and developer are advised there remains sufficient control through highways legislation to ensure any shortfalls are addressed, and if adoption is anticipated, bring those to suitable standard. The condition can be discharged as it addresses the aims and ambitions of the permission.
