1.The development shall be carried out in accordance with the following plans and documents: a) Location Plan (Drawing Number 8175 P25, dated Oct 2022); b) Proposed Elevations (Drawing Number 8175 P24, dated Sept 2022); c) Proposed Floor Plan (Drawing Number 8175 P23, dated Sept 2022); d) Proposed Site Plan (Drawing Number 8175 P22, dated Sept 2022); e) Lanai Outdoor Iris Louvered Canopy Brochure (unreferenced and undated); f) Existing Levels Site Plan (Drawing Number 8175 P20 Revision A, dated 18.3.21); g) Proposed Levels Front Elevation (Drawing Number 8175 P21, dated Mar 2021); h) Construction programme (unreferenced and undated) i) RSPB sparrow terrace boxes specification (unreferenced and undated). The development shall be carried out in strict accordance with the levels hereby approved. The reason for the condition is:- For the avoidance of doubt and to ensure that the development takes place in the manner contemplated by the Local Planning Authority.
2.Notwithstanding Drawing Number 8175 P24 (dated Sept 2022) the development shall be built in accordance with the following material details: Brickwork: Ventura Cream multi stock bricks Cladding: Ecoscape timber composite slatted cladding board colour spiced oak Windows: Aluminium windows (Slate grey RAL 7015) Horizontal dividing planes: PPC Aluminium (Slate grey RAL 7015) Feature walls: Limestone The reason for the condition is: - To ensure appropriate materials are used in accordance with Policy CS9 of the adopted Great Yarmouth Local Plan Core Strategy (2015).
3.Construction work shall not take place outside the following hours:- 08:00 to 18:00 Mondays 08:00 to 18:00 Tuesdays 08:00 to 18:00 Wednesdays 08:00 to 18:00 Thursdays 08:00 to 18:00 Fridays 08:30 to 13:30 Saturdays and no work shall take place on Sundays or Bank Holidays. These hours shall only apply to work generating noise that is audible at the boundary of the nearest noise sensitive property. The reason for the condition is :- In the interests of the residential amenities of the occupiers of nearby dwellings in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
4.Prior to the first occupation of the development hereby permitted, the proposed access and on-site car parking area shall be laid out, demarcated, levelled, surfaced and drained in accordance with the approved plan and retained thereafter available for that specific use. The reason for the condition is: - To ensure the permanent availability of the parking/manoeuvring areas, in the interests of satisfactory development and highway safety in accordance with Policy I1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
5.Prior to the first occupation of the dwelling hereby approved, the glazed panel on the southern balcony (Drawing Number 8175 P24, dated Sept 2022) shall be installed. The glazed panel shall remain in the approved form in perpetuity thereafter. The reason for the condition is :- In the interests of neighbouring amenity and to prevent overlooking in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
6.The windows labelled as obscure glazed on the southern elevation (Drawing Number 8175 P24, dated Sept 2022) shall be fitted with obscure glass to a level equivalent to Pilkington Privacy Level 5 which shall be installed prior to the first occupation of the dwelling and this obscure glazing shall be retained in perpetuity. These windows shall be non-opening and shall remain non-opening in perpetuity. The reason for the condition is :- In the interests of neighbouring amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
7.There shall be no occupation of the dwellings until the bird boxes have been installed in accordance with the RSPB sparrow terrace boxes specification. The bird boxes shall remain in perpetuity The reason for the condition is :- To secure biodiversity enhancements in accordance with Policy CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015).
8.In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until: a) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and b) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority. The reason for the condition is :- To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy E6 of the adopted Great Yarmouth Local Plan Part 2 (2021).
9.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking and re-enacting that order) the dwelling shall not be further extended in any way or outbuildings built without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any further extensions to the dwelling in the interests of residential amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021).
10.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order) no additional windows or other openings shall be made without the prior consent of the Local Planning Authority. The reason for the condition is:- To enable the Local Planning Authority to retain control over any extensions to the dwellings in the interests of residential amenity in accordance with Policy A1 of the adopted Great Yarmouth Local Plan Part 2 (2021)..
11.REASON FOR APPROVAL OF THE APPLICATION :- The proposal is considered to accord with Core Strategy Policies CS9 and CS10 and Local Plan Part 2 Policy A1.
12.STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner.
13.NOTES - Please read the following notes carefully:- Occasionally European protected species, such as bats, can be found during the course of the development. In the event that this occurs, it is advised that the developer stops work immediately and seeks the advice of a suitably qualified ecological consultant.
