| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the following plans received by the Local Planning Authority on the 20th January 2023:

and in accordance with the revised plans received by the Local Planning Authority on the 20th January 2023:

| 3. | No commencement of the development hereby approved shall take place until such a time that detailed designs of a surface water drainage scheme have first been submitted to and agreed in writing by the Local Planning Authority.
The approved scheme will be implemented prior to the first use of the development.
The scheme shall address the following matters:
a) The existing surface water drainage arrangements for the site, including existing rates and volumes of surface water run-off;
b) The proposed details of managing and discharging surface water from the site, including the use of sustainable drainage systems and accounting for the predicted impacts of climate change, including projected rates and volumes of surface water run-off;
c) Mechanisms for restricting discharge rates to greenfield rate;
d) Demonstration of how the hierarchy of drainage options has been followed;
e) How run-off from the completed development will be prevented from causing an impact elsewhere;
f) A maintenance and management plan detailing the activities required, the frequency of the activities and details of who will adopt and maintain the all the surface water drainage features for the lifetime of the development; and,
g) details of the type of interceptor and method of treatment.
The reason for the condition is:-
To prevent flooding in accordance with LPP1 Policy CS13 by ensuring the satisfactory management of local sources of flooding surface water flow paths, storage and disposal of surface water from the site in a range of rainfall events and ensuring the SuDS proposed operates as designed for the lifetime of the development. |
| 4. | With the exception of above ground clearance, demolition works and tree protection works, no development shall take place until the following components of a scheme to manage the risks associated with contamination of the site have been submitted to and approved, in writing, by the local planning authority as necessary:
1) A preliminary risk assessment which has identified:
a) all previous uses
b) potential contaminants associated with those uses
c) a conceptual model of the site indicating sources, pathways and receptors
d) potentially unacceptable risks arising from contamination at the site;
2) If the preliminary risk assessment identifies a potential unacceptable risk from contamination, a site investigation scheme and a full risk assessment, based on the preliminary risk assessment shall be undertaken, to provide information for a detailed assessment of the risk to all receptors that may be affected, including those off site. The site investigation scheme and full risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The report of the findings must include:
a) a survey of the extent, scale and nature of contamination
b) an assessment of the potential risks to:
(i) human health;
(ii) property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes;
(iii) adjoining land;
(iv) controlled waters;
(v) ecological systems;
(vi) archaeological sites and ancient monuments.
c) an appraisal of remedial options and proposal of the preferred option(s).
This must be conducted in accordance with the Governments guidance ' Land Contamination Risk Management'
3) If the site investigation scheme and full risk assessment identifies a need for remediation, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks identified at 2) b). The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of land after remediation.
4) Where a remediation scheme is submitted and approved under part 3) of this condition, the approved remediation scheme must be carried out in accordance with its terms prior to the commencement of groundworks, other than that required to carry out remediation, unless otherwise agreed, in writing, by the Local Planning Authority.
5) Where a remediation scheme is submitted and approved under part 3) of this condition, the local planning authority shall be given prior written notification of commencement of the remediation scheme works.
Following the completion of measures identified in any approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out shall be produced. No occupation of the development shall take place until the verification report has been submitted to and approved in writing by the local planning authority, unless a revised timetable for submission of the verification report has been first agreed in writing by the local planning authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with sections 178 and 179 of the NPPF and Local Plan Part 2 Policy E6. The condition is pre-commencement as it is essential that the contamination on site is investigated, and a remediation plan drawn up before construction commences to ensure that pollutants are not mobilised and to avoid and future harm to residents. |
| 5. | In the event that contamination that was not previously identified is found at any time when carrying out the approved development, it must be reported in writing immediately to the Local Planning Authority. All development shall cease and shall not recommence until:
1) a report has been submitted and agreed in writing by the Local Planning Authority which includes results of an investigation and risk assessment together with proposed remediation scheme to deal with the risk identified and
2) the agreed remediation scheme has been carried out and a validation report demonstrating its effectiveness has been approved in writing by the Local Planning Authority.
The reason for the condition is :-
To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptor as required by policy E6 of the Local Plan Part 2. |
| 6. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order (2015), as amended, the premises hereby permitted shall only be used for Storage (within use class B8) and as offices (within Use Class E g) i), and for no other purpose (including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and reenacting that Order with or without modification).
The reason for the condition is:
To enable the Local Planning Authority to retain control over any future changes of use of the application site in the interests of: the vitality and viability of the Town Centre as set out in Local Plan Policies GY1 and CS7; Yarmouth Business Centre safeguarded employment area as set out in Local Plan Policy CS6; and Amenity as set out in accordance with Local Plan Policy A1, as other uses in Class E include main town centre uses for which this location is a sequentially inappropriate location. |
| 7. | The northern access to the highway shown marked 'In' on the approved block plan within the submitted plans shall not be used for any purpose including construction traffic, until a scheme of signage for display within the site has first been submitted to and approved in writing by the Local Planning Authority to provide details which make it clear that this access shall not at any time be used for egress. The scheme shall receive the written approval of the local planning authority and be installed in accordance with that approval before the access is used, and shall thereafter be retained as such for the lifetime of the development.
The reason for the condition is :-
In the interests of highway safety in accordance with Core Strategy (2015) policy CS16. |
| 8. | Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order (2015), (or any Order revoking, amending or re-enacting that Order) no gates/bollard/chain/other means of obstruction shall be erected that might swing open outwards across the unadopted access road that is an extension to the adopted Thamesfield Way. Any gates etc shall swing into the site as shown on the submitted drawing.
The reason for the condition is: -
In the interests of highway safety in accordance with Core Strategy (2015) policy CS16. |
| 9. | No use of the building hereby approved shall take place until such time that details in written and drawn form of the access gates and the perimeter fencing has been submitted to and approved in writing by the Local Planning Authority. The approved access gates and perimeter fencing shall be installed prior to the first use of the building.
The reason for the condition is :-
In the interests of visual amenity, in accordance with Core Strategy (2015) policy CS09. |
| 10. | No works above slab level shall take place until full details of a soft and hard landscaping scheme have first been submitted to and approved in writing by the Local Planning Authority.
The precise details of the landscaping proposals shall include:
- full specifications of all new planting along with details for their protection during establishment, and
- details of all hard landscaping materials.
For the avoidance of doubt, all species used in the planting proposal shall be locally native species of local provenance.
The reason for the condition is :-
Because the precise details have not been submitted and in the interests of the satisfactory visual amenity in accordance with Core Strategy (2015) policy CS09. |
| 11. | The approved planting scheme secured by Condition 10 of this permission shall be carried out in its entirety within the first planting and growing season following the first use of the building hereby approved. For the duration of a period of 10 years from the first use of the building, any trees, shrubs or hedges planted in accordance with the landscaping scheme which die, are removed or become seriously damaged or diseased shall be replaced in the next immediate planting season with others of similar size and species.
The reason for the condition is :-
To ensure an high quality form of development and in the interests of ensuring appropriate visual amenity for the local area, to enhance biodiversity and to secure appropriate residential amenity in accordance with Policies CS09 and CS11 of the adopted Great Yarmouth Local Plan Core Strategy (2015). |
| 12. | Prior to the installation of any plant and machinery equipment, full details of any plant equipment proposed to be installed along with the associated noise data sheet(s) shall be submitted to and approved in writing by the Local Planning Authority. The plant equipment shall then be installed as per the approved details prior to the first use of the plant equipment and retained as such thereafter.
The reason for the condition is :-
To ensure that unacceptable levels of noise pollution are avoided, in accordance with Core Strategy (2015) policy CS09 and Local Plan Part 2 (2021) policy A1. |
| 13. | REASON FOR APPROVAL OF THE APPLICATION :-
The proposal provides an employment generating use within a safeguarded employment site, in accordance with Core Strategy (2015) policy CS06. |
