1.CONDITION 3 - REFUSED Condition 3 is NOT discharged. Condition 3 requires that the details of a surface water drainage scheme shall be submitted and approved prior to the commencement of any works. The information submitted shows that the proposed method of dealing with surface water is to connect to the combined sewer which is the least preferred method of dealing with surface water in the surface water drainage hierarchy. It has not been demonstrated to the satisfaction of the Local Planning Authority that all other options were explored and discounted, which is especially important in the Great Yarmouth Borough where combined sewers are already known to be generally at capacity and sustainable surface water solutions must be considered the preferred means of disposal unless proven otherwise unfeasible.
2.CONDITION 4 - REFUSED Condition 4 is NOT discharged. Condition 4 requires that a Phase 1 contamination report shall be submitted to and approved in writing by the Local Planning Authority and that if contamination is found, a Phase 2 report will need to be submitted to and approved in writing by the Local Planning Authority. The submitted Phase 1 report shows that due to the previous use of the land as a garage and the possibility of contamination from hydrocarbons and other potential contaminants, a Phase 2 report will be required. This has not been submitted. In the absence of a proposed strategy to remove or provide mitigation there is a risk that development will not remedy the effects of existing contamination, could increase the risk of contamination of soils transferring to groundwater, and could present a risk to human health; as such the condition cannot be discharged at this time.
3.CONDITION 7 - ONLY DISCHARGED IN PART Condition 8 requires an Asbestos report to be submitted and approved in writing by the Local Planning Authority prior to commencement of the works and that If asbestos is found removal must be carried out by suitable contractor. The application was supported by the following document: - ECI Refurbishment / Pre-demolition Survey of Asbestos Materials (survey completed 15th July 2022) The submitted document is sufficient to discharge Condition 7 in part. The condition cannot be discharged in full because the condition requires that removal and disposal of the asbestos needs to be carried out before the condition can be full discharged. The development must take place in accordance with the approved details.
4.CONDITION 10 - DISCHARGED IN PART Condition 10 requires details of the bin storage area to be submitted to and approved in writing by the Local Planning Authority and for the bin storage area to be installed prior to the occupation of the units. The application was supported by the following document: - Bin and cycle storage details (unnumbered plan) The submitted document is sufficient to discharge Condition 10 in part. The condition cannot be discharged in full because the condition requires that the bin storage area be installed prior to the first occupation of the units. The development must take place in accordance with the approved details.
5.NOTES - Please read the following notes carefully:- Planning permission 06/17/0697/F expires on the 30-01-2023. All pre-commencement conditions must be satisfied and approved, and a lawful commencement would need to take place in accordance with those details, before this date if the permission is to remain extant.
