1. | Condition 7 requires a detailed scheme for the off-site highway improvement works (footway, access and carriageway widening as appropriate) to be submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority.
The application was supported by Drawing No. 00/001 - Existing Utilities Layout; Drawing No. 02/001 - Drainage Layout; Drawing No. 03/001 - General Arrangement; Drawing No. 03/002 - Construction and Kerbing Layout; Drawing No. 03/003 - Site Clearance; Drawing No. 03/004 - Proposed Levels; and Drawing No. 03/005 - Standard Details.
The submitted details are hereby approved however this condition can only be discharged in part as the development has to be undertaken in accordance with the approved details. See also Notes below |
2. | Condition 13 requires the following information to be submitted to and approved in writing by the Local Planning Authority: (i) a full site survey showing: the datum used to calibrate the site levels levels along all site boundaries levels across the site at regular intervals floor levels of adjoining buildings (ii) full details of the proposed finished floor levels of all buildings and hard surfaces. The development shall be carried out only in accordance with the approved details. No development shall take place until full details of the finished levels, above ordnance datum, of the ground floor(s) of the proposed building(s), in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. The development shall be carried out in strict accordance with the levels approved.
The application was supported by Drawing No. LMS1600 Topographical Survey; and Drawing No. 02/101 Surface Water Drainage and Levels Layout.
The submitted details in terms of finished site levels in relation to existing ground levels are hereby approved however this condition can only be discharged in part as the development has to be undertaken in accordance with the approved details. |
3. | Condition 15 requires a scheme for surface water management to be submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details.
The application was supported by a Surface Water Drainage Strategy & Detailed Design dated September 2022 prepared by Create Consulting Engineers ref: JG/VL/P22-2537/02 volumes 1, 2, 3 and 4 of 4 and in particular Drawing No.'s 02/101 Surface Water Drainage and Levels Layout; 02/102 Drainage Standard Details; and 02/103 Exceedance Route Plan. The proposed method of drainage is attenuated discharge of surface water to a watercourse.
The submitted details are hereby approved however this condition can only be discharged in part as the development has to be undertaken in accordance with the approved details. See also Notes below. |
4. | Condition 16 requires that a bat survey shall be undertaken which shall ascertain if any bats are present within the site and shall include mitigation measures should bats be present. The development shall be carried out in accordance with the approved details.
The application was supported by a PEA dated 16 February 2022 prepared by Greenlight environmental consultancy ref: 2632 version 1.0. NCC Natural Environment Team were consulted on this and raised no objections subject to the mitigation recommendations for various ecological features on the site being implemented in accordance with and as outlined in section 7 of the PEA.
The submitted details are hereby approved however this condition can only be discharged in part as the development has to be undertaken in accordance with the approved details including mitigation/enhancement proposals and at the relevant time in the development process as set out in section 7 of the PEA. |
5. | Condition 18 requires a phase 1 contamination report to be carried out to assess whether the land is likely to be contaminated. The report shall also include details of known previous uses and possible contamination arising from those uses. If contamination is suspected to exist, a phase 2 site investigation is to be carried out. If the phase 2 site investigation determines that the ground contains contaminants at unacceptable levels then the applicant is to submit a written strategy detailing how the site is to be remediated to a suitable standard for its proposed end use. No dwellings/buildings hereby permitted shall be occupied until the remediation works agreed within the scheme have been carried out to the satisfaction of the Local Planning Authority.
The application was supported by a Contaminated Land Assessment dated May 2022 prepared by Create Consulting Engineers ref: TB/VL/P22-2537/01 volumes 1, 2 and 3 of 3. This was supplemented by an email from the agent dated 12 June 2003 providing a methodology for asbestos picking and confirmation that in terms of the capping of the former pond this will comprise stripping of the area of the former pond down by 600mm and replace with site-won suitable topsoil from other areas of the site that have been proved to be suitable.
The submitted details as supplemented are hereby approved however this condition can only be discharged in part as the development has to be undertaken in accordance with the approved details. |
6. | STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Great Yarmouth Borough Council has actively sought to work with the applicant in a positive and proactive manner. |
7. | NOTES - Please read the following notes carefully in relation to condition 7 above:-
The condition refers to the submission of a detailed scheme in respect of the off-site highway works which, given the works to the public highway can only be undertaken within the scope of a legal Agreement (a Section 278 or form thereof) between the Applicant and the Norfolk County Council, the LHA are of the view that the entering into the legal Agreement is a constituent part in the detailed scheme.
It is an OFFENCE to carry out any works within the Public Highway, which includes a Public Right of Way, without the permission of the Highway Authority. This development involves work to the public highway that can only be undertaken within the scope of a Legal Agreement between the Applicant and the County Council. Please note that it is the Applicant's responsibility to ensure that, in addition to planning permission, any necessary Agreements under the Highways Act 1980 are also obtained. Advice on this matter can be obtained from the County Council's Highways Development Management Group. Please contact developer.services@norfolk.gov.uk
Public Utility apparatus may be affected by this proposal. Contact the appropriate utility service to reach agreement on any necessary alterations, which have to be carried out at the expense of the developer. If required, street furniture will need to be re-positioned at the Applicant's own expense. |

The ability to construct the development will be dependant on the granting of any required Land Drainage Consent under Byelaw 3 from the Broads Internal Drainage Board as part of the Water Management Alliance - please refer to their consultation response dated 21 October 2022. |
