| 1. | The development must be begun not later than three years beginning with the date of this permission.
The reason for the condition is :-
The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| 2. | The development shall be carried out in accordance with the details on the application forms regarding external materials and the following plans:
. Site Location / Block & Site Plan Drawing No. 278.00 Rev A
. Ground Floor Plan Drawing No. 278
. First Floor Plan Drawing No. 278.12 Rev A
. Elevations Drawing No. 278.13 Rev A
The reason for the condition is:-
For the avoidance of doubt. |
| 3. | The planting of a replacement Oak Tree as indicated on Drawing No. 278.00 Rev A shall be carried out in the first planting season following the commencement of development. The replacement tree, if within a period of 5 years from the completion of the development dies, is removed or becomes seriously damaged or diseased, shall be replaced in the next planting season with another of similar size and species.
The reason for the condition is:-
In the interests of the visual amenities of the locality in accordance with Local Plan Part 2 Policy E4, and to replace the biomass and maintain biodiversity of a protected tree being removed as part of the development, in accordance with Local Plan Part 2 Policy E4 and Core Strategy policy CS11. |
| 4. | In relation to the garage outbuilding and the western elevation two-storey extension, excavations for the foundations and ground works shall be overseen by a suitably qualified competent Arboricultural Consultant, and if any large tree roots are found when excavating the foundations, these should be carefully dug around and protected as instructed by the Arboricultural Consultant.
The reason for the condition is: -
To ensure that no harm is done to existing trees in accordance with Local Plan Part 2 Policy E4. |
| 5. | No dormer windows or other openings at first floor level in the rear [north-west] elevation of the garage outbuilding shall be provided without the express written planning permission first being obtained from the Local Planning Authority (notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order, revoking, re-enacting or modifying that order)).
The reason for the condition is:-
To help safeguard the privacy and amenity of the occupiers of adjacent properties in accordance with Local Plan Policy A1. |
| 6. | The garage outbuilding hereby approved shall only be used for private domestic use in connection with the adjoining dwelling.
The reason for this condition is:-
For the avoidance of doubt and in the interests of the residential amenities of the occupiers of adjacent property. |
| 7. | No part of the garage outbuilding hereby permitted (neither ground floor or first floor) shall be used by anyone other than the occupiers of the adjoining dwelling, or their dependants, and shall not be used as a separate dwelling, or as an annex and nor shall it be let separately for holiday purposes including as Air B&B accommodation or similar.
The reason for the condition is :-
The form of development has been proposed and advertised as a garage and storage outbuilding, but its positioning adjacent to the site boundary with neighbouring dwellings could give rise to possible effects for residents of neighbouring premises, which have not been assessed as part of this application, such as amenity, traffic and disturbance impacts. The extended development hereby permitted relies on the garage to provide the space necessary for parking and turning within the curtilage. The site has not been shown to include a level of amenity commensurate with the requirements of an annex use. The restriction is therefore imposed to enable the Authority to retain control over the use of this part of the site and to ensure appropriate public scrutiny will be possible should such uses be proposed. |
| 8. | Notwithstanding the proposals within drawing no. 278 Ground Floor Plan, no permission is granted as part of this decision for the outdoor swimming pool or external shower wall enclosure. These elements are not included in the description of development applied for and they are not included in the proposed elevations and they require planning permission in their own right.
The reason for the condition is:-
For the avoidance of doubt. |
| 9. | NOTES - Please read the following notes carefully:-
The permission hereby granted relates solely to the alterations and extensions to the dwelling and the detached garage outbuilding and no permission is granted or implied for the outdoor swimming pool and means of closure forward of the principal elevation of the dwelling as illustrated on drawing no. 278 Ground Floor Plan. These works did not form part of the description of development as applied for and any such development will need to be the subject of a separate application for planning permission. |
