No.Condition Text
.In order for such a proposal to be granted Prior Approval, it is necessary that no development has taken place until the determination has been made. Significant works have commenced and therefore does not comply with Paragraph W(3), and is a breach of Condition G.1(d) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.Insufficient information has been submitted to determine whether the use class of the building to which the application relates can be considered to fall within a use class that would constitute permitted development in relation to the proposal as set out in reference to the types of 'permitted development' under Class G. As a result, the proposal fails to comply with Class G and G.1(a) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.In order for such a proposal to be granted Prior Approval, it is necessary that impacts of noise from commercial premises on the intended occupiers of the development is addressed. Insufficient information has been submitted to address this element. As a result, the proposal fails to comply with Condition G.1(d)(iii) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.In order for such a proposal to be granted Prior Approval, it is necessary that there is provision of adequate natural light in all habitable rooms of the dwellinghouses. Whilst the proposal indicates the insertion of windows, Class G only allows the change of use of the building, it does not permit any external alterations. As a result, the building without the external works would not allow natural light to all habitable rooms and thus fails to comply with Condition G.1(d)(iv) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.In order for such a proposal to be granted Prior Approval, it is necessary that arrangements required for the storage and management of domestic waste is submitted. Insufficient information has been submitted regarding this provision, which is stated to be located within the building, to ensure that odorous impacts and potential fire hazards are addressed. As a result, the proposal fails to comply with Condition G.1(d)(v) of Part 3, Schedule 2, to the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
.The site is located within the Orange 400m to 2.5km Indicative Habitats Impact Zone and the prior approval application proposes the net increase of one dwelling. As such a shadow template Habitat Regulation Assessment is required. This has not been received nor has the required £371.86 Green Infrastructure and Recreational Avoidance Mitigation Strategy payment been made to the Local Planning Authority. The proposal therefore does not satisfy criteria 9 and 10 of Part W of the Town and Country Planning (General Permitted Development Development) (England) Order 2015 (as amended).
